COUNCIL MINUTES July 8,1996 Council Member Bergeson asked if there are some areas where there has been inquiries and work done on site. Ms. Wyland said yes. She stated there have been neighborhood meetings and MUSA will be requested near 62nd Street. Another area that will request MUSA is approximately 20 acres south of Fox Trace. She stated that she believes the City will not have more requests for MUSA than what is available. Council Member Bergeson stated that 150 acres of MUSA is not a lot and it should be used wisely. Ms. Wyland stated that she does not believe all 150 acres of MUSA will be used. Council Member Lyden asked that the City Council remember the 150 acres of MUSA was approved with the idea that the City Council work together to adopt perimeters for its use. He stated he feels this request for MUSA is premature. Mr. Schumacher noted that at the last Council work session he submitted proposed criteria for MUSA allocation. This proposal will be evaluated at the next work session. Ms. Wyland stated that a rezone from Mr. Carlson was published. Mr. Carlson has withdrawn his application until the MUSA perimeters are established. Council Member Bergeson asked if this item is an emergency. Mr. Ahrens stated that time is a factor. He has been working with Mr. Vaughan since before the first of the year. He stated that the MUSA allocation is a natural progression. Council Member Lyden asked how Council can approve MUSA for Pheasant Hills Preserve and deny MUSA to someone on 62nd Street. Mr. Hawkins stated that a reason for approval should be given. Ms. Wyland stated that the property is properly zoned. No other property has correct zoning. She stated the City has to process a minor Comprehensive Amendment. She noted that rough grading has been completed. Mr. Wessel stated that the exchange of MUSA in the development is not very easy. The owner is not in control of the land that would have to be switched. Council Member Bergeson wondered if staff can articulate unique features of this request that would justify approval. He indicated he would like the City to be fair. Mr. Hawkins stated that no other final plat that does not have MUSA has been approved. The property is properly zoned. Mr. Wessel noted that the property is adjacent to MUSA property, it is a natural expansion of utilities, and it is properly zoned. Council Member Lyden asked if Council does approve this request, can the perimeters for MUSA allocation be addressed in the next Council work session. Council Member Kuether suggested the Council discuss the perimeters as soon as possible.
