COUNCIL MINUTES AUGUST 25, 1997 <br />PLANNING AND ZONING BOARD REPORT, MARY KAY WYLAND <br />FIRST READING, Ordinance No. 22 - 97, Rezone, Bruce Hanson, Aqua Lane, Preliminary <br />Plat and Planned Development Overlay (PDO) (4/5ths Vote) - Ms. Wyland explained that the <br />Planning and Zoning Board originally reviewed this matter in June and July of 1996. At that <br />time the Planning and Zoning Board recommended approval but Council expressed concern that <br />review of Planning District No. 2 had not been completed. Therefore, due to the absence of a <br />4/5ths Council vote, Mr. Hanson withdrew his request pending the outcome of Comprehensive <br />Plan meetings with respect to District No. 2. <br />Since that time, the Planning and Zoning Board and Council have approved District No. 2, and <br />Mr. Hanson s property has been designated as a Performance Land Use area. Mr. Hanson is now <br />again requesting that his property be rezoned so that he may develop five single-family home <br />sites zoned R -1X allowing for creation of seaplane bases and a shared taxi way to provide access <br />to the airstrip. A public hearing has been held, and Staff recommended approval of the rezoning <br />from GB to R -1X with a planned development overlay and approval of the preliminary plat <br />according to the following conditions: <br />1. The preliminary plat is revised so that Lot 6 and Outlot A are combined with the <br />adjacent Surfside Seaplane base property. <br />2. Hanger building materials and heights are specified and found to comply with <br />applicable City requirements. <br />3. Seaplane hangers not exceed 2,400 square feet in size. <br />4. No detached accessory building other than the seaplane hangers is allowed. <br />5. A copy of restrictive covenants to be applied to the proposed residential lots is <br />submitted for City review and approval. Such covenants must address architectural <br />requirements for hangers and include a provision that such hangers are to be used solely <br />for non-commercial airplane (seaplane) and related equipment storage. <br />6. It is demonstrated to the City that wetland boundaries have been delineated by a <br />qualified individual and drainage and utility easements are placed along all lot lines and <br />over all wetland areas subject to review and approval of the City Engineer. <br />7. Park Dedication requirements are applied as determined by the Park Board. <br />8. Grading/drainage/utility plans are reviewed and approved by the City Engineer. <br />9. All conditions of operation as required by the FAA and/or Minnesota Department <br />of Aeronautics are satisfied. <br />Council Member Lyden asked if the balance of the property to Lake Drive (presently zoned <br />General Business) is zoned specific to aircraft. Ms. Wyland explained that the remaining <br />property is covered under the Performance Land Use category included in the Comprehensive <br />Plan, which dictates that any business corning into that area would have to demonstrate to the <br />City s satisfaction that it would blend appropriately with existing businesses. <br />Council Member Lyden stated that he would like to see the entire area devoted to seaplane use <br />with a buffer between base and residential area. <br />5 <br />
