• <br />COUNCIL MINUTES DECEMBER 8, 1997 <br />CITY OF LINO LAKES <br />MINUTES <br />DATE : December 8, 1997 <br />TIME STARTED : 6:34 P.M. <br />TIME ENDED : 9:20 P.M. <br />MEMBERS PRESENT : Bergeson, Landers, Neal and Lyden <br />MEMBERS ABSENT : Kuether <br />Staff members present: City Administrator, Randy Schumacher; City Attorney, Bill Hawkins; <br />Community Development Director, Brian Wessel; City Engineer, David Ahrens; Economic <br />Development Assistant, Mary Alice Divine; Chief of Police, David Pecchia; Environment <br />Coordinator, Marty Asleson <br />SETTING THE AGENDA <br />Mayor Landers requested the addition of Consideration of Selection of a Construction <br />Management Company for the Public Facilities Complex as Agenda Item No. 7.B., Campaign <br />Signs under "Old Business", and Appointment to Friends of the Park as Agenda Item No. 12.B. <br />Council Member Neal requested addition of Campaign Contributions as Agenda Item No. 12.C. <br />Council Member Lyden requested that Agenda Item No. 9, Consideration of Amendments to the <br />City Administrator's Employment Agreement, be deleted. <br />Council Member Lyden moved that Agenda Item No. 9 be deleted. Motion failed for lack of a <br />second. <br />Council Member Lyden then presented four reasons why Agenda Item No. 9 should not be <br />considered at this time. His first reason was that the evaluation was not complete as he had not <br />submitted his portion of the evaluation. Second, this matter had not been presented at the most <br />recent Wednesday Council work session. <br />At this point Council Member Lyden pointed out that closure of the meeting at which Council <br />conducted its review of the City Administrator's employment agreement was not consistent with <br />the requirements of Statute 47.705, Section 1.E. City Attorney explained that the open meeting <br />law provides that the individual being reviewed must be named in the notice of such a meeting. <br />Mayor Landers stated that the official notice referred to the review as being of an employee. Mr. <br />Hawkins indicated that he had not seen the notice and therefore could not opine regarding the <br />correctness of its content. <br />The question was raised as to the validity of the review held at the subject meeting. Mayor <br />Landers pointed out that forms were completed and submitted, but no official Council action was <br />taken. <br />
