• <br />• <br />• <br />COUNCIL MINUTES DECEMBER 16, 1996 <br />Council Member Bergeson stated his feeling that cutting off the north end of the old Otter <br />Lake Road is imminent. Remaining to be decided is what will be the fate of the old road -- <br />will it become a dead end, or loop around to the new Otter Lake road. He added that he is <br />not in favor of a dead end situation; the loop is necessary. However, in light of the need for a <br />4/5ths vote of the Council to pass this issue, with a member absent there is a good chance that <br />it cannot be decided at this time. <br />Mayor Landers suggested that the first decision should be with respect to the public hearing. <br />Council Member Bergeson moved to close the public hearing at 7:41 p.m. Council Member <br />Lyden seconded the motion. <br />Council Member Neal indicated that he still has serious questions, such as where the "loop" <br />will be located, who will own the land, and who owns the park-and-ride lot. Mr. Powell <br />explained that the park-and-ride lot is on State property, and that it will probably remain <br />State right-of-way. <br />Motion carried unanimously. <br />CONSIDERATION OF EMERGENCY ORDINANCE NO. 10 - 96 PLACING A <br />MORATORIUM ON THE SITING OF PAWNBROKERS, PRECIOUS METAL <br />DEALERS AND SECONDHAND GOODS DEALERS, CHIEF PECCHIA <br />Mr. Schumacher explained that Chief Pecchia was unable to be present, and further explained <br />that the passage of this ordinance would give the Police and Community Development <br />Departments the opportunity to adequately research the implications of pawnbrokers, <br />secondhand goods dealers and precious metals dealers locating within the City of Lino Lakes. <br />He added that a number of municipalities within the metropolitan area are currently revising <br />and updating their existing ordinances relative to this matter to comply with recent changes <br />to State law. <br />Mr. Schumacher explained that Chief Pecchia anticipates having this research completed <br />within the next 12 months, and requested that this moratorium be in place during that time <br />period. This ordinance is considered to be of an emergency nature and requires only one <br />reading. Mr. Schumacher added that City Attorney Hawkins had prepared the ordinance for <br />Council approval. <br />Council Member Lyden moved to approve Ordinance No. 10 - 96, as presented. Council <br />Member Neal seconded the motion. Motion carried unanimously. <br />Ordinance No. 10 - 96 can be found at the end of these minutes. <br />FINANCE DEPARTMENT REPORT, MARY VASKE <br />Consideration of Resolution No. 96 - 158 Adopting the Final 1997 General Operating <br />Budget and the Sewer and Water Budgets for the City of Lino Lakes - Ms. Vaske <br />explained that pursuant to State Statutes, a final 1997 general fund revenue and expenditure <br />budget must be adopted by the City Council. Additionally, pursuant to the 1994 Utility Rate <br />Study, the 1997 budgets for the Water and Sewer Operating Funds should also be adopted by <br />Council. Ms. Vaske recommended approval of Resolution No. 96 -158, which encompasses <br />these budgets. <br />
