COUNCIL MINUTES MAY 26, 1998 <br />Ms. Wyland advised all Linda Avenue property owners present that they will not be required to <br />accept a rezone for their property. A letter will be sent out asking the property owners if they <br />would like their property to be rezoned. <br />Ms. Wyland asked the Council to table this issue until June 22, 1998. <br />Mayor Sullivan stated that she would like to see a written policy for sewer and water hook up for <br />residents not in the MUSA. She indicated that drainage is an issue regarding this development <br />and would like to see a plat. She also said that her main concern regarding this issue is the need <br />for commitment to quality in the area from the developer. Mayor Sullivan stated there is a real <br />concern with spot zoning and the residents need to understand what spot zoning entails. <br />Council Member Lyden stated that he felt neither R-1 or R -1X zoning was acceptable in this <br />neighborhood, as the difference between the two (2) was only a few feet. He believes it is the <br />Council's responsibility to uphold the integrity and character of that area. He stated the City <br />does not have the right to create a new neighborhood by destroying another neighborhood. <br />Council Member Bergeson asked why the issue had to be tabled for such a long period of time. <br />Ms. Wyland explained that June 22, 1998, was the first Council meeting after the next Planning <br />and Zoning meeting. <br />Mr. Wessel explained that the deadlines had been waived by the developer to meet the time table <br />of the June 22, 1998, Council meeting. <br />Council Member Bergeson pointed out that four (4) of the five (5) Council Members must be <br />present to approve a rezone. He stated he would not be present at the June 22, 1998, Council <br />meeting. <br />Ms. Wyland suggested Council table the item until the July 13, 1998, Council meeting. <br />Council Member Bergeson moved to table the Collova Addition Rezone, Ordinance No. 07 - 98, <br />and Interim MUSA Reserve, Resolution No. 98 - 69, until July 13, 1998. Council Member <br />Lyden seconded the motion. Motion carried unanimously. <br />Judy Bruner, 270 Linda Avenue, came forward and expressed her concern regarding the rezone <br />of this area. She stated that the development would triple the density of homes on 1/4 of the <br />block. She also stated that the road is a narrow rural road and the developer has no plans to <br />improve it. Ms. Bruner said that property values and the preservation of a rural area also <br />concerned her. <br />Council Member Neal asked why the developer is not being asked to improve the road. Mr. <br />Ahrens indicated that the road improvement could be a condition of approval. <br />Mayor Sullivan stated that this issue would be further discussed at the City Council Work <br />Session scheduled for July 8, 1998. <br />6 <br />
