COUNCIL MINUTES NOVEMBER 23, 1998
The Planning and Zoning Board recommended approval of this site plan review to allow the
relocation of a single family home onto the property at the south/west corner of Birch Street and
Centerville Road on a 7-0 vote with following conditions:
1. Proper building permits are obtained for all construction and the home is located to as
to conform to all City rules and regulations and the Uniform Building Code.
2. The applicant connect to City Water, if practical. (A water line exists along Birch
Street).
3. Prior to occupancy, the following improvements shall be made:
a. Reroof
b. Re -insulate
c. Re -stucco
d. Replace windows
e. Replace stairway to basement
4. An access permit is obtained from Anoka County.
Ms. Wyland noted Mr. and Mrs. Houle are present and concurred with the above
recommendations.
Mayor Sullivan asked if the applicants are aware of the proposed Comprehensive Plan regarding
the plans for the property to the east of them.
Mr. and Mrs. Houle, 707 Harriet in Shoreview, came forward and indicated they are aware of the
plans in the proposed Comprehensive Plan. Ms. Houle stated her only concern is it would be
much easier to have the garage in before the house. That way, the garage can be used for tools
for the house. Currently, the poles for the pole barn have to go in the cement block after the
house is moved.
Ms. Wyland stated there is no hardship to the land. A variance could not be obtained. The house
needs to be moved and then the accessory building (pole barn) can be constructed.
Mayor Sullivan explained five (5) steps need to be met in order to obtain a variance according to
State Statute. The City Council cannot change these requirements.
Council Member Bergeson stated that the way the house sits on the property the front is on a
narrower dimension. He asked if they are not putting the backyard toward Birch. Ms. Houle
indicated the backyard will not be facing Birch Street.
Council Member Lyden asked if the minimum setback requirements will be met. Ms. Wyland
stated the minimum setback required is 40 feet. The City is asking for a 50 foot setback which
the applicants have agreed to.
4
