COUNCIL MINUTES JANUARY 22, 2001 <br />The City Attorney has indicated that the City would not be able to assess street construction costs <br />upon subdivision of the Mar Don Acres lots unless prior approval from the affected property owners <br />is received. This prior approval is not required for the City to assess utility costs. <br />Based on the neighborhood meeting that was held Thursday, January 11, 2001 and other <br />conversations with Mar Don Acres residents, the City is not able to secure prior approval from these <br />residents for street assessments. Therefore, the proposed assessments to Bluebill Ponds as indicated <br />in the original Feasibility Study, remain unchanged. <br />Mayor Bergeson opened the public hearing at 7:10 p.m. <br />Council Member Dahl moved to close the public hearing at 7:10 p.m. Council Member Reinert <br />seconded the motion. <br />Council Member Carlson inquired about the status of the Feasibility Report. Staff advised the <br />Feasibility Report will remain as is. The next step is to order the improvement and preparation of the <br />plans and specifications and is being delayed for further review by the . kz - r. The developer is <br />reviewing the option for developer improvements as opposed to C. i:ovey nts. <br />Council Member Carlson asked how that will affect the prop <br />Acres. At <br />that meeting, the City Council also discussed and approved the development agreement for this <br />project. The development agreement included a negotiated settlement of the costs related to <br />installation of utilities in the area by the developer, T & G Properties, and the City of Lino Lakes. <br />As noted on Exhibit D of the agreement, the developer extended sanitary sewer and water service to <br />serve areas north of Main Street and outside the limits of the plat. The costs associated with this <br />utility extension have been thoroughly reviewed and the amount requested, $135,030.80, is a <br />reasonable amount for this work done. <br />• <br />
