CITY COUNCIL WORK SESSION APRIL 3, 2002 City Engineer Studenski advised the Holte pond is in the Weber Addition outside of the existing easement. This issue has been discussed previously by the Council. The City is at the point of eminent domain to obtain the additional easement. Staff has submitted the necessary paperwork to the City Attorney. A time frame regarding the eminent domain process will be available in a few weeks. Staff will obtain bids to finish the work on the pond and storm sewer. Councilmember O'Donnell stated the City wanted to negotiate with the homeowner and only use eminent domain as a last resort. City Engineer Studenski stated the City is currently at the point of eminent domain. Councilmember O'Donnell stated the pipe will not completely solve the issue of water in neighbors' basements. If the homeowner keeps filling the pond the City can then eliminate the pond completely with the eminent domain pr • `;mss.
