COUNCIL MINUTES AUGUST 12, 2002 <br />Ms. Sherman indicated a lighting plan has been submitted for review. The ordinance provides for <br />maximum lighting levels of one -foot candle at the street and 0.4 when casting lighting onto a <br />residential property. Because of the proximity to residential uses, the type of fixture will be critical. <br />The ordinance requires that light sources be hooded or controlled. The fixture proposed is decorative, <br />round cutoff luminaries that has the option of a solid dome or glow dome. Staff believes all of the <br />lights should include a solid dome. No specific lighting type has been provided for under the canopy. <br />Lighting under the canopy shall be designed with completely recessed lighting and lot lighting on the <br />canopy sides. <br />Ms. Sherman advised the grading, drainage and utility plans have been received and all are subject to <br />the City Engineer's comment dated July 3, 2002. All standard easements are to be dedicated with the <br />final plat. There is an existing drainage and utility easement to be vacated that was previously platted <br />with the Spirit Hills subdivision; this shall be completed prior e issuance of a building permit. <br />Ms. Sherman indicated park dedication has not previously been • on this parcel. As a result, <br />the proposed final plat will be subject to park dedication re.u= For commercial development, <br />a park dedication of $2,175.00 per acres is required. The 1¢ : incl `_. es 3.75 acres, which requires a <br />park dedication of $8,156.25, to be paid prior to recordi h plat. <br />Ms. Sherman advised the development is intended ®. a use for retail and service uses consistent <br />with the GB District. Three uses proposed on the . lan lude a day care facility, motor fuel station <br />(convenience store) and bank with drive-thru, ires a conditional use permit. Approval of <br />these uses are included as part of the PDO ap al but are identified here for clarity in what will be <br />permitted. The Planning and Zoning Boar 'e the criteria for recommending a conditional use <br />permit and has addressed those criteria, ultin m a favorable recommendation. <br />Ms. Sherman indicated the Enviro « ` : o eviewed the proposed development on April 24, <br />2002 and recommended approval. 3 mments were attached to the staff report and, where <br />applicable, have been Inco • a oto s port. <br />Ms. Sherman advised the Rice eek Watershed District granted a Table With Authorization For <br />Administration Action on Febru 27, 2002, pending resolution of Wetland Conservation Act issues. <br />The applicant is proposing to fill 8,000 square feet of existing wetland on the site. 3,041 square feet <br />is proposed to be mitigated on-site. The applicant is currently working with the Rice Creek <br />Watershed District to satisfy the remaining mitigation requirements through a comprehensive <br />drainage plan for the site, future Ware Road extension and surrounding properties. The wetland <br />delineations have been approved and Rice Creek Watershed District has agreed to work with the <br />applicant to create the best solution for wetland impacts and protection. No permit for the work at <br />Spirit Hills will be issued until the overall impacts are addressed during the Ware Road permitting <br />process. <br />Ms. Sherman indicated a copy of the application has been submitted to Anoka County for review. <br />Their comments will need to be incorporated into the site design.
