• <br />• <br />COUNCIL MINUTES OCTOBER 14, 2002 <br />Comment: While the zoning ordinance allows a one acre lot to be created under the <br />homestead clause, the minimum Rural lot standards preclude the creation of such a lot <br />that would also comply with the City's minimum lot depth standards. <br />4.) That granting the variance requested will not confer on the applicant any <br />special privilege that would be denied by this ordinance to other lands, <br />structures, or buildings in the same district. <br />Comment: The property in question has the necessary lot area to conform to the minimum <br />requirements of the homestead clause. <br />5.) That the proposed actions will be in keeping with the spirit and intent of the <br />ordinance. <br />Comment: The Variance is in keeping with the spirit and intent of the ordinance which <br />allows for homesteaded properties to reduce their lot to minimum of one acre if the <br />balance of the property results in a parcel of ten acres. <br />The above report was presented at the August 14 & September 11x`2002 meeting of the Planning & <br />Zoning Board. After consideration of the issues, Board member voted to recommend approval of the <br />Minor Subdivision, with the following conditions: <br />1.) A park dedication fee of $1,665 to be paid prior to the certification and recording of the <br />Minor Subdivision. <br />2.) The applicant shall dedicate to the City drainage and utility easements measuring ten feet <br />in width along the front and rear property lines, five feet in width along side property lines, <br />and covering all ponding andetland areas. Such dedication shall be in the form of a Quit <br />Claim Deed, per the City att ney, to be submitted prior to the certification and recording <br />of the Minor Subdivision.. <br />3.) The applicant shall dedicate to Anoka County the required public right-of-way adjacent to <br />Ash Street. Such dw ion shall be submitted prior to the certification and recording of <br />the Minor Subdivision. <br />Associate Planner Gretz advised that based on the findings stated above, staff recommends approval. <br />Councilmember Carlson asked for clarification regarding the amount of required right-of-way. <br />Associate Planner Gretz advised the right-of-way is 60 feet. <br />Councilmember Dahl moved to adopt Resolution No. 02 —117, as presented. Councilmember <br />Reinert seconded the motion. Motion carried unanimously. <br />Resolution No. 02 — 117 can be found in the City Clerk's office. <br />Consider Resolution No. 02 —144, Final Plat Approval and Allocation of MUSA Reserve, <br />Clearwater Creek Fifth Addition, Jeff Smyser — City Planner Smyser advised this is the last phase <br />• of the Clearwater Creek development, which received preliminary plat and rezoning approval in April <br />9 <br />
