The Park Board has recommended approval of the following <br />arrangement for City Council consideration: <br />The Pheasant Hills Home Owners Association will provide the following: <br />1. A commitment to remove trees damaged by the path construction and removal of any fill <br />material that has strayed from the construction area. (DONE) <br />2. A letter from the Rice Creek Watershed District indicating their approval of the construction <br />recently done. (DONE) <br />3. A signed quitclaim deed providing a 20' wide trail easement where the existing trail is located. <br />(DONE) <br />The City of Lino Lakes will be responsible for the following: <br />1. Reimburse the owner of Outlot C $750 for the installation of the culverts. <br />2. Pay for the aggregate that will be installed by the owner of Outlot C. <br />3. Commit to asphalt the trail when funds become available. <br />• 4. Continue this trail to connect with the existing Regional Park Reserve Trail System when <br />funds become available. <br />The estimated cost to complete the trail project, including material cost for the aggregate, installation <br />of the bituminous, and extending the trail to the Regional Park Reserve Trail System is $35,000. <br />Staff is recommending approval of Resolution No. 02 — 178, directing the City Attorney to execute <br />the quitclaim deed for a twenty foot wide trail easement on Outlot C, Pheasant Hills 11th Addition. <br />Councilmember Carlson asked who is executing the quitclaim deed. City Administrator Waite Smith <br />advised the Pheasant Hills Home Association is executing the quitclaim deed. They are the ones that <br />are providing the easement to the City. <br />Councilmember Carlson stated the agreement does not spell that out. <br />Councilmember O'Donnell asked about the possibility of the County sharing the costs of the trail <br />connection as they have done in the past. City Administrator Waite Smith advised staff is looking <br />into that possibility. <br />Councilmember Carlson moved to adopt Resolution No. 02 — 178, as presented. Councilmember <br />O'Donnell seconded the motion. Motion carried unanimously. <br />• Resolution No. 02 — 178 can be found in the City Clerk's office. <br />15 <br />
