• <br />• <br />CITY COUNCIL WORK SESSION FEBRUARY 19, 2003 <br />APPROVED <br />City Planner Smyser reviewed the following changes that have been made to the zoning <br />ordinance: <br />• A new single family residential zone has been created: R -EC, Single Family Estate <br />Conservation. This allows for "clustering" in a single family zone, but requires that <br />any space saved by using smaller lots must become open space. (Sec. 2, Subd. 3, p.6- <br />12) <br />• The site and building plan review process will be entirely an administrative function <br />rather than going through P & Z and City Council review. If there is a variance <br />request or appeal of the administrative decision by the applicant, it would be brought <br />though P & Z and Council. This is similar to making minor subdivisions an <br />administrative review. <br />• Planned unit developments normally will be addressed with conditional use permits. <br />A new set of requirements for a PUD is at Section 2, Subd. 10, page 2-39. The <br />ordinance provides for rural clusters as well as urban residential PUDs. Any mixed- <br />use development will require a PUD rezoning, per Sec. 9, Subd. 3. <br />• Reduced number of categories for accessory building size maximums and increase in <br />the amount of accessory space for small lots (less than 1 1/4 acre). The former <br />maximum was 1120 sf, it has been raised to 1200. <br />• Landscaping requirements have been clarified and updated. Tree preservation <br />requirements for commercial and residential building have been added. <br />• The Central Business District will become General Business, and the CB zone deleted <br />from the ordinance. The Shopping Center district will be deleted, and shopping <br />centers will be conditional uses in the business districts. <br />Councilmember Carlson asked for clarification regarding why applicants not being able <br />to resubmit applications for one year after being denied was removed. <br />City Planner Smyser stated the current language says that no application for rezoning <br />which has been denied can be resubmitted for one year unless reasons for denial have <br />been met or the application is reconsidered by the City Council. <br />Mayor Bergeson stated the language should read that the applicant cannot come back and <br />be reconsidered for one year. <br />City Planner Smyser suggested possible language that would clarify that section of the <br />ordinance. The Council determined the clarification would be added before the first <br />reading of the ordinance is approved on Monday night. <br />
