Mayor Reinert voted yea. <br />3 <br />4 Motion carried unanimously. <br />5 <br />6 Ordinance No. 05-03 can be found in the City Clerk's office. <br />7 <br />8 ii) Consideration of Resolution 03-28, Approving Preliminary Plat, Keefe <br />9 Estates, Michael Grochala <br />10 <br />11 Community Development Director Grochala indicated he had no additional information. He <br />12 indicated in response to the Mayor's comments, Staff first required bituminous roadway, however <br />13 after a lengthy discussion at the Planning and Zoning Meeting, Staff laid out the minimum <br />14 requirements according to the fire codes, which is 20 feet. He indicated the City usually does not <br />15 approve private streets, and when they are approved it is usually in conjunction with townhomes <br />16 where it is sometimes more appropriate. He noted that as indicated in the report, when the City has <br />17 altered on width, it has not altered on materials. He stated that at the Planning and Zoning Board <br />18 meeting it was asked what the intention of the road would be. He reiterated Staff's recommended <br />19 minimum, and that they believe it should be paved, as the possibility exists that down the road it will <br />20 not be maintained and could become a city liability. He added that it will be in the association <br />21 agreement to maintain the road, but ultimately this is the City Council's discretion. <br />• 22 <br />23 Councilmember Carlson clarified that the larger portion of the lot will be set aside and cannot be <br />24 subdivided again until water and sewer were available. She asked if this did not present an <br />25 opportunity for development of the road at that time. Community Development Director Grochala <br />26 indicated it could. He stated the property to the west of the access area is a Stage 2 development area, <br />27 slated for sewer and water after 2010. He indicated they could come in with sewer and water from the <br />28 west, where everything would come off the public street, where there would be no need to improve <br />29 the roadway. He added that they could bring the street into the driveway also to allow further <br />30 development. <br />31 <br />32 Councilmember Carlson asked what the length is from Rolling Hills Drive to the cul-de-sac. <br />33 Community Development Director Grochala stated it was 660 feet. Councilmember Carlson asked <br />34 how wide it is at the beginning of the property. Community Development Director Grochala stated <br />35 the driveway tapers, but is about 13 feet at the beginning, with a 60 foot right-of-way. He indicated it <br />36 tapers from 18 Y2 feet to 12 or 13 feet. <br />37 <br />38 Councilmember Carlson asked how much right-of-way was claimed. Community Development <br />39 Director Grochala indicated there was no public right-of-way, but the property easement is 60 feet. <br />40 City Planner Smyser asked if the easement to the exception parcel the City would require would be <br />41 public or private. City Attorney Hawkins stated it would be private. <br />42 <br />al43 Mayor Bergeson indicated that assumptions are being made that some day a future development and <br />44 road will be here, and asked if the City has adequately addressed the right-of-way for the road if it <br />45 happens.
