APPROVED <br />1 CITY OF LINO LAKES <br />2 SPECIAL MEETING <br />3 MINUTES <br />4 <br />5 <br />6 DATE : March 24, 2003 <br />7 TIME STARTED : 6:02 P.M. <br />8 TIME ENDED : 6:12 P.M. <br />9 MEMBERS PRESENT : Councilmembers Carlson, Dahl, O'Donnell, Reinert <br />10 and Mayor Bergeson <br />11 MEMBERS ABSENT : None <br />12 <br />13 Staff members present: City Administrator, Linda Waite Smith; City Clerk, Ann Blair; Police <br />14 Sergeant Kurt Rausch. <br />15 <br />16 LIQUOR LICENSE VIOLATIONS <br />17 <br />18 Mayor Bergeson explained that a special meeting of the City Council was being held to address liquor <br />19 license violations. He noted that any actions discussed and agreed upon would be handled during the <br />20 regular City Council meeting to follow. He asked Sergeant Rausch to present his report. <br />21 <br />22 Sergeant Rausch stated there were two violations during recent liquor license checks. The first was <br />23 the American Legion, where two underage buyers purchased two cans of Miller Lite from the <br />Aik 24 bartender, which were then taken into evidence. He stated a citation was issued, which has been paid. <br />lar 25 The second violation was at Shirley Kaye's, where the same two underage buyers purchased a Miller <br />26 Lite bottle and Miller Lite tap. Again a citation was issued and has been paid. He stated that under <br />27 the Best Practices grid, the department recommends a $500 fine and no suspension. <br />28 <br />29 Jaime Olivas indicated he was the bartender at the American Legion during the check. He stated he is <br />30 also the Third Vice Commander, in charge of children. He is a volunteer bartender as the club has not <br />31 been doing very well. He explained he was very sorry for the incident, and indicated he had no <br />32 intention of knowingly selling liquor to a minor, and has taken care of the situation in court. He <br />33 stated he has even volunteered to do community service work because he felt bad about the situation. <br />34 <br />35 Matt Conway stated he was the bartender at Shirley Kaye's the night of the violation. He indicated <br />36 that while he is not making excuses, he noted he was working on what should have been his night off, <br />37 and was due to get off at 10:00, just before the check took place, however the relief bartender was <br />38 late. He stated he was counting the till when the buyers came in and it was simply a mistake. He <br />39 indicated he had no intention of selling to underage buyers, stating he has five children himself and he <br />40 does not like people who provide liquor to children. He stated the management at Shirley's are <br />41 always reminding staff to check ID's, and indicated the fault was his, for which he is very sorry. He <br />42 indicated he has taken care of the matter in criminal court, and there was no intent. <br />43 <br />44 Mayor Bergeson asked the owners and managers of the establishments if they were aware of the <br />45 recommendation that will come at the City Council Meeting, which they indicated they were. He <br />46 asked if they were aware of the training programs available, and the American Legion manager asked <br />47 for more information about them. Mayor Bergeson asked him to speak with Sergeant Rausch after <br />1p 48 the hearing. <br />
