CITY COUNCIL WORK SESSION OCTOBER 22, 2003 <br />APPROVED <br />1 area. A final assessment roll was distributed, noting the adjustments to the project and <br />• 2 the City's portion of the project in the amount of $105,000. A bond would be used to <br />3 pay for the City's portion over a ten-year period. The City already has spent <br />4 approximately $78,000 on the project. At a minimum, minor repairs have to be made on <br />5 21St Avenue. <br />6 <br />7 Councilmember O'Donnell inquired about any other possible cost savings in relation to <br />8 the final project. City Engineer Studenski advised that the City would not know the <br />9 extent of possible additional cost savings until construction begins. <br />10 <br />11 Councilmember O'Donnell inquired about the City's portion of the project and how that <br />12 will impact the budget. Finance Director Rolek advised the project would not impact the <br />13 2004 levy, but would impact the 2005 levy. <br />14 <br />15 Ms. Joan Tschida, resident of Lino Lakes, distributed a letter from a private appraiser that <br />16 indicated the improvements made to 21st Avenue would not add any value to her <br />17 property. However, storm sewer is desperately needed and there is value to that. <br />18 <br />19 Councilmember Carlson arrived at the meeting at 5:49 p.m. <br />20 <br />21 Ms. Tschida advised she does not mind paying for a portion of the improvements. <br />22 However, $80,000 is too much when the improvements will not add any value to the <br />23 property. <br />•24 <br />25 Community Development Director Grochala stated the Council previously received a <br />26 copy of a letter from Mr. Lessard regarding this issue. Mr. Lessard is very much in favor <br />27 of the project and has indicated he may pursue legal action if the project does not move <br />28 forward. <br />29 <br />30 Mayor Bergeson asked what would happen to the project if two or more of the property <br />31 owners petition out of the project. Community Development Director Grochala advised <br />32 the City would have to prove its case in court. The Council needs to take action on this <br />33 matter on Monday night. The project would have to be approved on Monday night to <br />34 ensure the project is completed this year. <br />35 <br />36 Councilmember O'Donnell asked if there is any way to reduce the City's risk involved <br />37 with the project. Community Development Director Grochala advised that if the two <br />38 property owners agree to the new assessments, the City Attorney could develop a waiver <br />39 for their signatures. Staff is recommending the City move forward with the project. <br />40 <br />41 Councilmember O'Donnell indicated he would like the signed waivers in place before the <br />42 City moves forward with the project. <br />43 <br />44 This item was added to the regular Council agenda Monday, October 27, 2003, 6:30 p.m. <br />45 <br />46 <br />S47 <br />48 <br />
