COUNCIL MINUTES JANUARY 12, 2004 <br />APPROVED <br />2 Councilmember Dahl stated this Council and the Environmental Board support a lot of open space. <br />3 She stated that each telephone message stated their preference of medium density if it could not be <br />4 single-family density. She stated one caller, Mary Jo, said she thought there was too much <br />5 development in the area with all the cars that would be generated from the new development. <br />6 Councilmember Dahl stated she would not be voting in support of the requested amendment. <br />7 <br />8 Councilmember Carlson stated she will vote to uphold the Comprehensive Plan that the citizens and <br />9 Council worked together to pass on a unanimous vote. She stated she does not believe the <br />10 Comprehensive Plan should be changed to accommodate high density on this site and supports the <br />11 findings of fact listed in Resolution No. 04-01 <br />12 <br />13 Councilmember Carlson stated when she joined the Planning & Zoning Board before the Council, she <br />14 attended the Government Training Service and Planning Institute. She read a comment from that <br />15 Institute related to plans and regulations; plans represent a blueprint and goal, and regulations <br />16 represent the implementation to reach the goals. She stated that the City's Comprehensive Plan is a <br />17 core document of any planning effort and the Zoning Ordinance is a tool to implement the <br />18 Comprehensive Plan so that comes first. <br />19 <br />20 Councilmember Carlson stated on Wednesday, the Planning & Zoning Board considered an <br />21 application regarding rezoning from high density to medium density and several statements were <br />22 made that uphold State law and statutes and the Zoning Ordinance. She stated she would like that <br />23 document, which was the staff report for that meeting, included in the findings of fact and then read <br />24 each of them. <br />•25 <br />26 Councilmember Carlson referred to the Planned Unit Development (PUD) and noted that page 2-33 <br />27 of the Zoning Ordinance requires consistency between the PUD and Comprehensive Plan. She <br />28 referred to a memorandum from City Planner Smyser regarding the amount of right-of-way the <br />29 County wants along the arterial road, approximately one-quarter acre. She stated that in taking the <br />30 numbers given, and while it may not be 100% accurate, it says the site is 4.05 acres and taking out <br />31 another one-quarter acre makes it 3.8 divided by 46 units which equals slightly over the high density <br />32 amount. <br />33 <br />34 Councilmember Carlson noted that the issue of water was mentioned in the presentation by the <br />35 developer. She stated there are issues with problematic water connections of existing homes that <br />36 needs to be corrected. <br />37 <br />38 Councilmember Carlson noted this project was denied unanimously by the Environmental Board and <br />39 the Comprehensive Plan amendment was denied twice, unanimously, by the Planning & Zoning <br />40 Board. She stated that at the October Council work session, four members of the Council told the <br />41 applicant that he should be looking at a rezone on this, rather than a Comprehensive Plan amendment <br />42 and, at the last Planning & Zoning Board meeting, several documents were listed as being worked on <br />43 in the application but all did come in after the October 22 date. <br />44 <br />45 Councilmember Carlson stated that on the issue of consistency with the Comprehensive Plan, the <br />46 Comprehensive Plan was approved by the Metropolitan Council as meeting or exceeding the goals <br />47 therein. She referred to other townhome projects in Lino Lakes that were approved and that the <br />• 48 Bruggeman property was cited as a reason to consider this one.
