City Planner Smyser indicated this condition should be changed to add a line, reading 9194 as follows: This conditional use permit approval includes the 2100 -seat worship 195 space, but not the additional 700 seats. This approval also includes the 50 -foot 196 building height as shown on the submitted building plans. The addition of more 197 seating requires an amendment of this conditional use permit. The review of the 198 amendment will include, but not be limited to, the adequacy of the wastewater 199 treatment system and traffic impacts on the transportation system. 200 3. If weekday evening worship services are scheduled, they shall not occur prior to 7:00 201 p.m. in order to avoid conflict with the weekday peak travel period (rush hour). This 202 condition does not apply to small worship activities that create no traffic issue and 203 does not apply to special holiday or other special events. 204 6. Parking lot lighting and church spire lighting shall be turned off no later than two 205 hours after services or other events at night but no later than 10:00 p.m. This does not 206 apply to special holiday or other special events. City Planner Smyser indicated the 207 church is requesting this be changed to 11:00 p.m., and the neighborhood group 208 submitted some changes they would like to see which indicated they would be okay 209 with 11:00 p.m. as well. He stated Staff is in support of this change. 210 10. Prior to the issuance of a building permit, the church must obtain written approval 211 from Anoka County Highway Department that the westbound right turn lane at the 212 CSAH 14/CSAH 21 intersection will function as demonstrated in the submitted traffic 213 analysis. The church must make any improvements to the turn lane as required by 214 Anoka County. City Planner Smyser stated Staff wants to make sure the turn lane is 215 functioning as intended. He indicated they have found out the turn lane is already 216 eight feet shorter than necessary. He stated it is up to Anoka County to decide if 217 improvements need to be made. 218 11. The church shall be responsible for the construction and cost of a right turn lane on the 219 northbound I -35E exit ramp at CSAH 14. 220 a. The church shall obtain agreement on the design of this turn lane from 221 Anoka County Highway Department and Mn/Dot, as necessary, and 222 submit proof of the agreement, prior to issuance of a building permit for 223 the church. 224 b. This turn lane shall be completed prior to issuance of a certificate of 225 occupancy for the church. 226 City Planner Smyser stated the church has concerns with this condition, and suggested 227 that rather than saying prior to certificate of occupancy that escrow be held to cover 228 additional improvements needed. He indicated the church has several changes they 229 will be proposing to the conditions. 230 231 Mayor Bergeson indicated he knows some or all the City Council will have comments, and ask that 232 they be held until the City Council deliberation period. He stated if there are brief questions they can 233 be asked now. 234 235 Councilmember Carlson asked the square footage of the building footprint. City Planner Smyser 236 stated it is 57,463 square feet. 237 238 Councilmember Reinert indicated because of the sensitive nesting environment for the Heron from 239 April 15 to July 15, he wondered if Staff was recommending limitations on construction times.
