City Planner Smyser indicated this condition should be changed to add a line, reading <br />9194 as follows: This conditional use permit approval includes the 2100 -seat worship <br />195 space, but not the additional 700 seats. This approval also includes the 50 -foot <br />196 building height as shown on the submitted building plans. The addition of more <br />197 seating requires an amendment of this conditional use permit. The review of the <br />198 amendment will include, but not be limited to, the adequacy of the wastewater <br />199 treatment system and traffic impacts on the transportation system. <br />200 3. If weekday evening worship services are scheduled, they shall not occur prior to 7:00 <br />201 p.m. in order to avoid conflict with the weekday peak travel period (rush hour). This <br />202 condition does not apply to small worship activities that create no traffic issue and <br />203 does not apply to special holiday or other special events. <br />204 6. Parking lot lighting and church spire lighting shall be turned off no later than two <br />205 hours after services or other events at night but no later than 10:00 p.m. This does not <br />206 apply to special holiday or other special events. City Planner Smyser indicated the <br />207 church is requesting this be changed to 11:00 p.m., and the neighborhood group <br />208 submitted some changes they would like to see which indicated they would be okay <br />209 with 11:00 p.m. as well. He stated Staff is in support of this change. <br />210 10. Prior to the issuance of a building permit, the church must obtain written approval <br />211 from Anoka County Highway Department that the westbound right turn lane at the <br />212 CSAH 14/CSAH 21 intersection will function as demonstrated in the submitted traffic <br />213 analysis. The church must make any improvements to the turn lane as required by <br />214 Anoka County. City Planner Smyser stated Staff wants to make sure the turn lane is <br />215 functioning as intended. He indicated they have found out the turn lane is already <br />216 eight feet shorter than necessary. He stated it is up to Anoka County to decide if <br />217 improvements need to be made. <br />218 11. The church shall be responsible for the construction and cost of a right turn lane on the <br />219 northbound I -35E exit ramp at CSAH 14. <br />220 a. The church shall obtain agreement on the design of this turn lane from <br />221 Anoka County Highway Department and Mn/Dot, as necessary, and <br />222 submit proof of the agreement, prior to issuance of a building permit for <br />223 the church. <br />224 b. This turn lane shall be completed prior to issuance of a certificate of <br />225 occupancy for the church. <br />226 City Planner Smyser stated the church has concerns with this condition, and suggested <br />227 that rather than saying prior to certificate of occupancy that escrow be held to cover <br />228 additional improvements needed. He indicated the church has several changes they <br />229 will be proposing to the conditions. <br />230 <br />231 Mayor Bergeson indicated he knows some or all the City Council will have comments, and ask that <br />232 they be held until the City Council deliberation period. He stated if there are brief questions they can <br />233 be asked now. <br />234 <br />235 Councilmember Carlson asked the square footage of the building footprint. City Planner Smyser <br />236 stated it is 57,463 square feet. <br />237 <br />238 Councilmember Reinert indicated because of the sensitive nesting environment for the Heron from <br />239 April 15 to July 15, he wondered if Staff was recommending limitations on construction times.
