The City received an interpretation from the State Building Codes office <br />22 regarding this issue, which was included in the Council packets. <br />23 <br />24 Community Development Director Grochala stated the City operates under the Minnesota <br />• 25 State Building Code which includes the International Building Code (IBC) and as a <br />26 subset the International Residential Code (IRC) which deals with one and two-family <br />27 residential structures. As stated in the interpretation provided by the state, if the hangars <br />28 are constructed under the IBC, which defines residential hangars as having a maximum <br />29 size of 2,000 square feet, then the limitations set forth in that code would apply. <br />30 However, the definition of accessory structures within the IRC does not differentiate <br />31 between residential accessory buildings and aircraft hangars. Under such interpretation <br />32 residential hangars would be treated the same as other residential accessory structures <br />33 (i.e., garage, pole barn etc.). <br />34 <br />35 Community Development Director Grochala stated based on the state's comments and <br />36 concerns raised by the Lino Air Park, staff will move forward with permit reviews based <br />37 on the IRC. This will allow for hangar construction without the installation of sprinklers. <br />38 However, it should also be noted that this interpretation also eliminates more stringent <br />39 requirements for fire separation setbacks and fire wall construction. <br />40 <br />41 Community Development Director Grochala advised staff would continue to work with <br />42 the Centennial Fire Department to seek an amendment to the next building code that <br />43 clarifies this issue.
