Under the previous code, as well as the revised code, falcons would be <br />5 prohibited in residential areas. <br />6 <br />7 Council directed staff to follow up with the individual that inquired about falcons and <br />8 inform him of the City process regarding this issue. <br />9 <br />10 JOINT POWERS AGREEMENT REQUEST — PINE HOLLOW, CIRCLE PINES, <br />11 GORDON HEITKE <br />12 <br />13 City Administrator Heitke advised the City of Circle Pines is requesting the two cities to <br />14 enter into a joint powers agreement (JPA) to allow for the City of Lino Lakes to provide <br />15 sanitary sewer service for a 52 -unit single-family housing development known as Pine <br />16 Hollow. Prior to entering into a JPA with Lino Lakes, sanitary sewer lines were <br />17 constructed by the developer. After further research, it has been determined that these <br />18 lines were constructed on private property, without permission and obtaining necessary <br />19 easements form the property owner. The City of Lino Lakes should not consider <br />20 executing a JPA until such time that adequate easements are obtained from the private <br />21 property owner, or the sanitary sewer lines are proposed to be relocated and proper <br />22 easements are obtained. <br />23 <br />24 City Administrator Heitke stated another issue of concern in approving another JPA with <br />25 Circle Pines at this time relates to the recent violation by Circle Pines of the JPA for Rice <br />26 Lake Estates Park. The City of Lino Lakes entered into a JPA with the City of Circle <br />27 Pines in 1998 in which the City of Lino Lakes leased approximately one acre of land for <br />28 25 years with an extension option of 15 years and expended $45,000 in playground <br />29 equipment, a basketball court and other site amenities. On September 22, 2004 the City <br />30 of Circle Pines removed the playground equipment without notifying Lino Lakes staff. <br />31 The sudden destruction of the facilities has left residents of Rice Lake Estates without a <br />32 park. Staff is presently working with Circle Pines staff to determine how and when this <br />33 situation will be remedied. <br />34 <br />35 City Administrator Heitke distributed an e-mail from the City Attorney regarding this <br />36 issue. He asked if the Council is comfortable with the City Attorney drafting a letter <br />37 outlining the City's intent in regard to the JPA at such time as all issues have been <br />38 resolved. <br />39 <br />40 Public Services Director DeGardner advised staff met with Jim Keinath, City <br />41 Administrator of Circle Pines, earlier today regarding this issue. Circle Pines has agreed <br />42 to install new playground equipment at Baldwin Park this summer. He noted Lino Lakes <br />43 City staff also indicated to the City of Circle Pines the desire for a basketball court after <br />44 the park is master planned and developed. <br />45 <br />46 Council directed staff to advised the City Attorney to draft a letter outlining the City's <br />47 intent regarding the JPA after all outstanding issues have been resolved. <br />
