SPECIAL COUNCIL MEETING OCTOBER 10, 2005 <br />APPROVED <br />• 1 <br />2 <br />3 CITY OF LINO LAKES <br />4 MINUTES <br />5 <br />6 <br />7 <br />8 DATE : October 10, 2005 <br />9 TIME STARTED : 6:06 p.m. <br />10 TIME ENDED : 6:38 p.m. <br />11 MEMBERS PRESENT : Councilmember Carlson, Dahl <br />12 Reinert, Stoltz and Mayor Bergeson <br />13 MEMBERS ABSENT : None <br />14 <br />15 Staff members present: City Administrator, Gordon Heitke; City Attorney Bill Hawkins <br />16 <br />17 JOINT MEETING WITH CHARTER COMMISSION <br />18 <br />19 City Administrator Heitke reviewed that this issue had been discussed at the October 5, <br />20 2005 Work Session and it was determined to hold a special Work Session tonight to <br />21 discuss the proposed agenda for the joint Charter Commission/City Council meeting. <br />22 This item was also added to the regular Council agenda for further discussion tonight. <br />S23 <br />24 Councilmember Stoltz asked for clarification that the joint agenda items are 4A through <br />25 E. He also asked about the Annual Charter Commission Report. City Administrator <br />26 Heitke replied agenda items are 4A through E. He added statute states the Charter <br />27 Commission must submit an annual report. <br />28 <br />29 Councilmember Stoltz asked if the spirit of law is frame and amend. He also asked if <br />30 there is a requirement on how often Council needs to meet with the Charter, and if there <br />31 are any other requirements. City Attorney Hawkins replied according to statute, frame <br />32 and amend is correct. He added a meeting should take place annually, but additional <br />33 meetings can be added if Council chooses. <br />34 <br />35 Councilmember Stoltz stated he is uneasy voting on the agenda as is. He requested a <br />36 header "potential amendments" be added to follow the frame and amend statute. <br />37 <br />38 Councilmember Reinert requested a header "amendments regarding" be added for clarity. <br />39 <br />40 Councilmember Carlson asked if a header is required and if it is illegal to discuss the <br />41 noted agenda items with the Charter Commission. She added amendments must be <br />42 discussed rather than forced. City Attorney Hawkins replied it is not illegal to discuss <br />43 items with the Charter Commission; it is a Council decision; there are no legal <br />44 requirements. <br />• 45 <br />
