Council directed staff to confirm attendance with the City Attorney or <br />• 23 have a written response from the City Attorney available. <br />24 <br />25 There were no other changes to the regular Council agenda. <br />26 <br />27 NPDES MS4 PERMIT <br />28 <br />29 Mr. Jakes advised in compliance with the provisions of the Clean Water Act, as amended, <br />30 Minnesota Statutes Chapters 115 and 116, as amended, and Minnesota Rules Chapter <br />31 7001, the City adopted a Storm Water Pollution Prevention Plan and authorized its <br />32 submittal to the Minnesota Pollution Control Agency (MPCA) as part of the City's <br />33 application for enrollment in the State of Minnesota's General National Pollution <br />34 Discharge Elimination System (NPDES) Phase II Permit Authorizing the City's discharge <br />35 of storm water. <br />36 <br />37 Mr. Jakes stated the NPDES MS4 Permit authorizes discharge of storm water within a <br />38 framework of a Stormwater Pollution Prevention Plan (SWPPP), which has 6 control <br />39 measures with a total of 34 mandatory best management practices (BMPS). <br />40 <br />41 Mr. Jakes advised the permit has been revised to meet the requirements of a May 2003 <br />42 Minnesota Court of Appeals decision in which the court required the MPCA to provide <br />43 opportunity for public review of the SWPPP, and address nondegradation for all waters. <br />44 The permit now includes new public notice requirements and new Appendices D and E, <br />• 45 which contain nondegradation requirements for Selected MS4s. <br />46 <br />
