COUNCIL MINUTES SEPTEMBER 25, 2006 <br />APPROVED <br />• 1 <br />2 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br />3 <br />4 There was no report from the Administration Department. <br />5 <br />6 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA <br />7 <br />8 There was no report from the Public Safety Department. <br />9 <br />10 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />11 <br />12 There was no report from the Public Services Department. <br />13 <br />14 COMMUNITY DEVELOPMENT DEPARTMENT REPORT, MICHAEL GROCHALA <br />15 <br />16 Public Hearing, Consider 1St Reading of Ordinance No. 09-06, Amending the Zoning Ordinance <br />17 to Modify the Allowable Uses within the NB, Neighborhood Business, and the LB, Limited <br />18 Business and GB, General Business Zoning Districts, Jeff Smyser - City Planner Smyser advised <br />19 the City Council directed staff to initiate a rezoning of the commercial lot on the southeast corner of <br />20 the intersection of Birch St. and Hodgson Rd. Consideration of development of that property raised <br />21 concern about the uses on that site allowed by the zoning ordinance. The Council considers some of <br />• 22 the potentially allowable uses in the Limited Business zone to be undesirable for this specific site. <br />23 Examination of the differences between the Limited Business and Neighborhood Business zones led <br />24 to recommendations to amend the ordinance to change some of the uses allowed in the three business <br />25 zoning districts. <br />26 <br />27 City Planner Smyser provided the staff analysis as well as reviewed the staff recommended zoning <br />28 amendments. He noted the amendment regarding extended care facilities has been removed for <br />29 further review. <br />30 <br />31 Mayor Bergeson opened the public hearing at 6:55 p.m. <br />32 <br />33 Mr. Peter Hiliger, Representative for Bruggeman Properties, came forward and read a letter from <br />34 Bruggeman Properties objecting to the proposed changes and outlining other conditional uses <br />35 Bruggeman Properties would like added to the ordinance. He asked that the letter be entered into the <br />36 official record of the meeting. <br />37 <br />38 Mr. Hiliger questioned staff regarding the proposed changes and requested clarification on those <br />39 proposed changes. <br />40 <br />41 City Planner Smyser clarified staff's recommendation regarding each of the proposed amendments. <br />42 <br />40 43 Council Member Carlson moved to close the public hearing at 7:05 p.m. Council Member Stoltz <br />44 seconded the motion.
