Motion carried unanimously. <br />2 <br />3 Consider Resolution No. 06-162, Approving Summary Publication of Ordinance No. 09-06, Jeff <br />4 Smyser — City Planner Smyser advised Resolution No. 06-162 is the approval of a summary <br />5 publication of Ordinance No. 09-06. <br />6 <br />7 Council Member Carlson moved to approve Resolution No. 06-162, as presented. Council Member <br />8 Stoltz seconded the motion. Motion carried unanimously. <br />9 <br />10 Consider 2nd Reading of Ordinance No. 10-06, Rezone Certain Real Property from LB, Limited <br />11 Business, to NB, Neighborhood Business, Lot 1, Block 16, Millers Crossroads, Located at the <br />12 Southeast Corner of Birch Street and Hodgson Road, Jeff Smyser — City Planner Smyser advised <br />13 the City Council approved the first reading of this ordinance on September 25. The subject site is <br />14 located at the southeast corner of Birch Street and Hodgson Road. The rezoning changes the site <br />15 from LB Limited Business to NB, Neighborhood Business. <br />16 <br />17 Council Member Stoltz moved to approve second reading of Ordinance No. 10-06, as presented. <br />18 Council Member Reinert seconded the motion. <br />19 <br />20 A roll call vote was taken: five yeas and zero nays. Motion carried unanimously. <br />S21 <br />22 Consideration of Resolution No. 06-158, Authorizing Distribution of Environmental Assessment <br />23 Worksheet for Public Comment, Nature's Refuge, Jeff Smyser — City Planner Smyser distributed <br />24 additional information to be included in the EAW that also included a list of agencies the EAW is <br />25 distributed to. <br />26 <br />27 City Planner Smyser advised Nature's Refuge is a conservation development project that was the <br />28 topic of a May 31 presentation to a joint meeting of the City Council and all the advisory boards. The <br />29 site lies north of Main Street, generally between Lake Drive and Wood Duck Trail. The project <br />30 would have a restoration and management plan for the conservation area. <br />31 <br />32 City Planner Smyser noted the City does not yet have a project application. The City does have an <br />33 Environmental Assessment Worksheet (EAW). Information gathered through the EAW process will <br />34 inform the design of the project before the submittal of a formal development application. <br />35 <br />36 City Planner Smyser outlined the process for the EAW and comment period. He noted the decision to <br />37 distribute the EAW for public comment is not an approval of the development project. The City is <br />38 following the environmental review process as required by state statute and the rules of the EQB. <br />39 <br />40 Council Member Reinert moved to approve Resolution No. 06-158, as presented. Council Member <br />41 O'Donnell seconded the motion. <br />42 <br />•43 Council Member Carlson made a friendly amendment to the motion to change the text reading "very <br />44 preliminary discussion" to "has begun discussion" and "approximately 600 acres" changed to <br />45 "approximately 680 acres". <br />3 <br />
