COUNCIL MINUTES January 8, 2007 <br />APPROVED <br />0135 <br />136 Council Member Reinert moved to approve Resolution No. 07-01, as presented. Council Member <br />137 O'Donnell seconded the motion. Motion carried unanimously. <br />138 <br />139 Public Hearing and Consideration of Resolution No. 07-06, Negative Declaration on the Need <br />140 for an Environmental Impact Statement (EIS) for Nature's Refuge, Jeff Smyser — Senior Planner <br />141 Smyser explained that the required Environmental Worksheet (EAW) was prepared for this project <br />142 and a review process occurred. Written comments from agencies and citizens were received and are <br />143 included in the information provided to the council; response to those comments is required. A <br />144 Record of Decision that includes findings, comments and responses, and conclusions is being <br />145 presented and the next step in the process is a decision on the necessity of an EIS. The Record of <br />146 Decision was reviewed by the Environmental Board, revisions were made and the Board then <br />147 approved a determination that an EIS is not necessary. <br />148 <br />149 Smyser indicated that Jason Husveth, Ecologist, Critical Connections, Inc. is working for the <br />150 developer on this project and was present to answer questions. <br />151 <br />152 Mayor Bergeson opened the public hearing at 7:05 p.m. <br />153 <br />154 Mark Bakke, 8107 Diane Street, said he is concerned about traffic levels in the area and asked if there <br />155 is an upgrade planned for the intersection of Lake Drive and Main Street? Also, will this <br />1,156 development increase utility needs and cause the city to need more water towers, etc? <br />57 <br />158 Dave Andersen, 803 Orange Street, asked how his water and sewer services will be impacted by the <br />159 development. Also, is there access planned through the development for schools and parks? <br />160 <br />161 Mr. Featherstone, 631 Andall Street, said he is concerned about traffic especially with the larger <br />162 development planned for the sod farm property. <br />163 <br />164 Darlene Storms, 620 Andall Street, asked if she can be assured that the pathway included in the <br />165 development will be a walking/bike path and not a roadway that could add to traffic concerns. <br />166 <br />167 Rich Ingersol, 864 Orange Street, stated that he is concerned about the impact on the wetlands. The <br />168 storm sewers can get very high already and the area has a very high water table. <br />169 <br />170 Erikka Bakke, 8107 Diane Street, said she'd like to see an EIS done. She is concerned about the <br />171 amount of grassland and wetland reduction that could occur. <br />172 <br />173 Dave Ledman, 535 Andall Street, stated that there are rare species of plants involved; based on that, <br />174 how a conclusion could be made that there is no environmental impact. He believes that the <br />175 development of the nearby sod farm land should be a part of considering this development. <br />176 <br />177 Steve Mockenhaupt, 8185 Wood Duck Trail, asked the council to look seriously at surface water <br />x}78 drainage in the area; that must be considered as well as the impact on wildlife. <br />79 <br />4 <br />
