CITY COUNCIL WORK SESSION May 29, 2007 <br />APPROVED <br />• 46 reviewing a variance was reviewed and it was pointed out that granting a variance in good <br />47 faith leaves the city with no liability in the matter. <br />48 <br />49 Chad Wagner reviewed his special event plans, noting that the event site would be <br />50 basically the same as past years as indicated on the site plan provided with his <br />51 application. Weather is a big consideration for staging this event and a tent is vital. A <br />52 smaller tent that would meet set back requirements wouldn't be sufficient for the number <br />53 of participants. <br />54 <br />55 Fire Chief Bennet said that he doesn't have a problem with the variance request. <br />56 <br />57 Item 3Aii, Resolution No. 07-81 regarding Miller's on Main Special Event Permit <br />58 and Cabaret License - City Clerk Bartell reported that Chad Wagner owner of Miller's <br />59 on Main located at 8001 Lake Drive, has applied to the City for a special event and <br />60 cabaret permit to conduct his annual music tent event on August 17 and 18, 2007. To <br />61 ensure that the event is planned to comply with appropriate regulations, including public <br />62 safety requirements, a list of conditions has been developed that includes the council's <br />63 direction that the Police Department monitor sound levels throughout the event. Also a <br />64 condition is included that requires Mr. Miller to obtain a variance to the state fire code <br />65 relative to his tent setback.
