COUNCIL MINUTES November 26, 2007 APPROVED 136 •137 It was clarified that the issue is not one with financial community as much as with the underwriters 138 for land resale possibilities. 139 140 To tighten the proposed ordinance amendment, a council member recommended that Section 2B, 141 subdivision 2b be amended to read: 142 143 b. There exists a habitable single family home constructed after July 13, 1992, and the creation 144 of a new lot is needed to provide security to a third party lending institution for owner 145 financing of the existing habitable single family home. 146 147 Attorney Baumgartner suggested that language could be helpful but there would remain many 148 different scenarios that could come up and there is really not a way to tighten the language to cover 149 them all. The amendment addresses a unique situation but it opens the door for other applications. 150 151 A council member offered support for the ordinance. The impact on future development of Lino 152 Lakes will not be drastic but approval of the language should be very important to a few residents. 153 Thanks were offered to the City Attorney and staff for bringing forward the solution. 154 155 Full reading of the ordinance was dispensed with by unanimous consent. 156 157 A council member expressed concern about the staff recommendation for denial. The ordinance may 58 be revisited and corrected if necessary. It is clear that this will be a relief for some residents in a 159 certain situation. 160 161 Council Member Stoltz moved to approve the 1st Reading of Ordinance No. 19-07, with the inclusion 162 of the suggested amendment to Section 2B, subd 2b. Council Member Carlson seconded the motion. 163 Motion carried: Yeas, 4; Nays 0; Absent — Mayor Bergeson. 164 165 Approval of Resolution No. 07-189, Extension of the Preliminary Plat and Variance Approvals for 166 Fran's Estate — Community Development Director Grochala explained that the applicant has indicated that 167 they will not be able to meet the deadline for final platting of this two -lot residential subdivision and they 168 are requesting a 12 month extension to the deadline. Staff does not object to the extension. 169 170 Council Member Carlson moved to approve Resolution No. 07-189 as presented. Council Member 171 Reinert seconded the motion. Motion carried. 172 173 Approval of Resolution No. 07-188, Extension of the Final Plat Approval for Golden Acre — City 174 Engineer Studenski explained that the applicant has indicated that they will not be able to meet the deadline 175 for final platting of this four -lot residential subdivision and they are requesting a 90 day extension to the 176 deadline. Staff does not object to the extension. 177 178 It was verified that this is the first request for extension. 179 • 4
