043 <br />COUNCIL MINUTES June 23, 2008 <br />APPROVED <br />FINANCE DEPARTMENT REPORT, AL ROLEK <br />44 There was no report from the finance department. <br />45 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br />46 3A) Consider 2"d Reading of Ordinance No. 10-08, establishing a moratorium on the <br />47 issuance of off -sale liquor licenses - City Clerk Bartell reported that, during discussions about <br />48 new off -sale liquor licenses last month, the council expressed a desire to review the city's current <br />49 liquor ordinance. Subsequently the council directed staff to prepare a moratorium ordinance <br />50 restricting issuance of off -sale liquor licenses for six months to allow time for review of the <br />51 city's current off -sale liquor licensing regulations as they relate to number, location and <br />52 proximity. First reading of Ordinance No. 10-08 establishing a moratorium on the issuance of <br />53 off -sale liquor licenses in the city occurred on June 9, 2008. The ordinance is presented for <br />54 consideration of second reading and approval. <br />55 <br />56 Council Member O'Donnell moved to dispense with full reading of the ordinance. Council <br />57 Member Gallup seconded the motion. Motion carried on a voice vote. <br />58 <br />59 Council Member Gallup moved to approve the second reading and adoption of Ordinance No. <br />60 10-08 as presented. Council Member O'Donnell seconded the motion. A roll call vote was <br />61 taken. Consider 2' Reading of Ordinance 09-08, Amending the Lino Lakes City Code, by <br />66 adding a new Section 304 related to Administration and Regulation of Public Right -of -Way <br />67 — Public Services Director DeGardner reported that staff is presenting for council consideration <br />68 1) the second reading of Ordinance No. 09-08 (Right of Way Ordinance); and 2) approval of <br />69 Resolution No. 08-65 that would authorize summary publication of the Ordinance No. 09-08 if it <br />70 is approved. He explained that the first reading of the ordinance was approved by the council on <br />71 June 9, 2008. The proposed regulations would bring all companies under one uniform set of <br />72 standards, streamline the franchising process, and remove questions about the extent of the city's <br />73 authority over non -franchised utilities. <br />74 <br />75 Council Member Gallup moved to dispense with full reading of the ordinance. Council Member <br />76 O'Donnell seconded the motion.
