COUNCIL MINUTES July 14, 2008 <br />APPROVED <br />e1 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br />42 3A. Resolution No. 08-67 approving a special event permit and cabaret license for Miller's <br />43 on Main, outdoor tent event on August 15 and 16, 2008 — Administrator Heitke reported that <br />44 Chad Wagner, owner of Miller's on Main, has applied for permits to conduct a music tent event <br />45 during the Blue Heron Days festival weekend. The council has previously granted a variance <br />46 from the fire code to allow the tent for this year only. The council has requested and the <br />47 conditions of the permit will include sound monitoring by the Police Department. Although it is <br />48 not specified in the conditions, the permit itself includes a limitation of hours on both nights of <br />49 the event from 9:00 p.m. to midnight. <br />50 <br />51 Representatives of the applicant were present to respond to questions. <br />52 <br />53 Council Member Stoltz moved to approve Resolution No. 08-67 as presented. Council Member <br />54 Reinert seconded the motion. Motion carried. <br />55 PUBLIC SAFETY DEPARTMENT REPORT, DAVE PECCHIA <br />56 There was no report from the Public Safety Department <br />57 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />58 There was no report from the Public Services Department <br />•59 COMMUNITY DEVELOPMENT REPORT, MICHAEL GROCHALA <br />60 6A. Resolution No. 08-71, Ordering Removal of Hazardous Structure, 745 Oak Lane - <br />61 Building Official Pete Kluegel reported that staff is requesting authorization to proceed with the <br />62 process to remove a hazardous structure located at 745 Oak Lane. The condition of the structure <br />63 is such that the roof has collapsed and is rotten, portions of the homes walls have been crushed by <br />64 trees, walls are rotting and moldy and the foundation is cracked as well as other deterioration. <br />65 Despite numerous letters to the property owner requesting rectification of many violations, the <br />66 property remains a nuisance. Staff is recommending that the council order the immediate <br />67 abatement and removal of the structure, allowing the state mandated process to proceed. <br />68 <br />69 Council Member O'Donnell moved to approve Resolution No. 08-71, as presented. Council <br />70 Member Stoltz seconded the motion. Motion carried on a voice vote. <br />71 <br />72 6B. Resolution No. 08-72, Approving Easement Acquisition, Lake Drive/35W Improvement <br />73 Project - Community Development Director Grochala reported that staff is requesting <br />74 authorization to proceed with an easement acquisition relating to the Lake Drive/35W interchange <br />75 project. Within a portion of the area known as the Judicial Ditch it has been identified that a <br />76 certain mitigation area is not included in the original easements gained for the project. Since this <br />77 easement as well as a temporary construction easement is necessary to the project, and based on <br />78 an appraisal, staff is requesting authorization proceed with said easement including payment to the <br />79 property owner in the amount of $9,957. <br />80 <br />• <br />-2- <br />
