COUNCIL MINUTES August 11, 2008 <br />APPROVED <br />.78 <br />Plarmer Bengtson reported that this ordinance is sponsored by staff to comply with the recently <br />79 approved and updated animal control regulations. There were some unrelated changes identified <br />80 in the process of review of these sections. The majority of changes being proposed are specific <br />81 to the city code changes regarding animal control and do not greatly change the requirements of <br />82 the ordinance but relate mainly to text changes. Other changes include amendments to align the <br />83 city with state statutes in regard to non -conforming uses and structures and amendments to <br />84 address the city policy to allow accessory structures to be placed in easements under certain <br />85 conditions, as well as some non -substantive grammatical errors. The Planning and Zoning Board <br />86 held a public hearing on the ordinance and then recommended approval. <br />87 <br />88 Council Member O'Donnell moved to dispense with full reading of the ordinance. Council <br />89 Member Stoltz seconded the motion. Motion carried on a voice vote. <br />90 <br />91 Council Member O'Donnell moved to approve the 2nd reading and adoption of Ordinance No. <br />92 11-08 as presented. Consider Resolution No. 08-84, Approving summary publication of <br />96 Ordinance No. 11-08 <br />97 <br />98 Council Member O'Donnell moved to approve Resolution No. 08-84, as presented. Council <br />099 Member Gallup seconded the motion. Motion carried. <br />00 <br />101 6B. Consider Resolution No. 08-82, Approving Statement of Concurrence, <br />102 VLAWMO/Rice Creek Watershed District Boundary Change <br />103 <br />104 Engineer Studenski reported that the Vadnais Lake Area Water Management Organization <br />105 (VLAWMO) is updating its watershed boundaries and, following the process set forth by state <br />106 statute, is proposing acceptance of the boundaries presented to the council in the staff report. <br />107 The changes for Lino Lakes relate to transfer of some land from Rice Creek Watershed District <br />108 to VLAWMO and vice versa. The city engineer is recommending approval of the changes. <br />109 <br />110 When the council asked how impacted citizens will be informed, Mr. Studenski explained that <br />111 these changes are brought to municipalities for adjustment and then return to the VLAWMO <br />112 board where a hearing with notice will be conducted. <br />113 <br />114 Council Member Gallup moved to approve Resolution No. 08-82, as presented. Consider Resolution No. 08-83, Accepting Quotes and Awarding a Contract, 2008 <br />118 Surface Water Management Project <br />119 <br />120 City Engineer Studenski reported on the receipt of quotes for a contract for the city's 2008 <br />21 Surface Water Management Program. Based on the two quotes received, staff is recommending <br />lip 22 award of the contract to Penn Contracting. <br />-3- <br />
