WS — Item #3 <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 3 <br />Date: May 4, 2015 <br />To: City Council <br />From: Julie Bartell, City Clerk <br />Re: Liquor Licensing, Elwood's — Clayton Gratz <br />Background <br />Elwood's is a new restaurant planned at 7997 Lake Drive, Suite 130. The restaurant <br />owner is Clayton Gratz, who has applied for a license to serve wine and strong beer. Mr. <br />Gratz currently holds an off -sale liquor license for the Liquor Barrel, 7997 Lake Drive, <br />Suite 120. <br />The Lino Lakes Code of Ordinances, Section 701.06, states that "no more than one <br />intoxicating liquor license shall be directly or indirectly issued within the city to any one <br />person." Based on this language and confirmation from the city attorney, Mr. Gratz is <br />not eligible for an additional intoxicating liquor license through the city. <br />Mr. Gratz has asked that staff review the city's liquor regulations to see if there are any <br />options that would allow him to proceed with his plans to serve alcoholic beverages at his <br />new restaurant. We have informed him that he could apply for an on -sale 3.2 license <br />(since that is technically not considered an intoxicating beverage). <br />At this point, Mr. Gratz has asked to come to the council work session to discuss this <br />situation and the language in the city code. <br />Attachments <br />City Attorney communication <br />
