2 <br />LIQUOR LICENSE SHALL NOT APPLY IF SCHOOL OR CHURCH IS IN LIMITED <br />OR GENERAL BUSINESS ZONING DISTRICT. <br />Ms. Divine informed the committee that a church would like to be the VFW, but churches are <br />not allowed in commercial zoning districts. She reviewed the planner’s staff report which <br />notified the council that a federal law does not allow cities to discriminate against like uses, and <br />churches were considered similar in use to lodges and clubs. Therefore, staff was recommending <br />that the zoning ordinance be changed. Council had requested EDAC’s opinion on this request. <br />EDAC sent the following recommendation to council: EDAC members agreed that the <br />enactment of federal law that requires like uses to be treated equally was enough reason to adopt <br />the amendment to the ordinance. Beyond that members acknowledged that this amendment <br />would allow uses that could remove properties from the commercial tax roles. However, such <br />uses were reasonable within areas that had infrastructure to support them and they attracted <br />people who would use city amenities such as restaurants and shopping. EDAC recommended <br />unanimously to support the proposed amendment to the GB and LB Zoning Districts. <br /> <br />A question arose regarding the need to include educational and public uses within GB and LB <br />Zoning Districts. EDAC requested staff opinion regarding the elimination of those uses which <br />are also not taxed from the amendment. However, members agreed that these uses attract people <br />who use commercial services. It was moved and seconded to recommend approval of the <br />ordinance as applies to churches only, removing schools and institution as conditional uses, <br />unless city staff indicates a need to keep those uses in the ordinance. Motion approved <br />unanimously. <br /> <br />DISCUSSION OF JOINT EDAC/COUNCIL MEETING <br />Ms. Keller said it was positive regarding opening the lines of communication. <br /> <br />UPDATES <br /> <br />Kraus Anderson <br />Staff noted that the developer will hold a second neighborhood meeting on Tuesday, Aug. 25 and <br />go to a council work session on Sept. 8. <br /> <br />DEED <br />Linda Tabor of DEED would like to attend a future meeting and describe what she does. <br /> <br />Ms. Divine was instructed to draft a memo of the points from this meeting for EDAC to see, and <br />then get to the council. Mr. Roeser will send out the draft of his development evaluation <br />proposal. <br /> <br />Televising All Council meetings <br />The Charter Commission is proposed a charter amendment to televise all council meetings, <br />including work sessions. This could potentially expand to include all boards and committees. <br /> <br />Next meeting will be September 3 at 7 a.m. <br /> <br />Meeting adjourned.
