Answers and Discussion of Alcohol IQ Test
1. True Alcohol is classified as a depressant.
2. False Coffee will NOT sober up an intoxicated person. Only time for the body to expel the alcohol will sober up
the individual.
3. True A large quantity of alcohol increases respiration and heart rate.
4. True You must be 21 years of age to purchase alcohol in Minnesota. NO EXCEPTIONS!!
5. False A new MN law eliminates the so called "power hour" no alcohol may be sold until 8am of the person's 21st
birthday.
6. False The primary basis for determining intoxication in court is NOT a blood alcohol level of .08 percent. The key
is "obvious signs of intoxication", which can include bloodshot eyes and slurred speech among others (see
page 9.)
7. True Minnesota law 340A.503 (see page 3.)
8. False There are several other valid forms of identification (see page 3.)
9. True 304A.503 (6) (B) (1) It is a defense for the defendant to prove by a preponderance of the evidence that the
defendant reasonably and in good faith relied upon the identification accepted. (See page 3 for acceptable
forms of identification.)
10. True You can sell non -alcohol beer to a minor, however, MLBA advises against this practice.
11. True An employee of a licensed liquor establishment may be subject to civil and/or criminal consequences for
serving a obviously intoxicated patron. (MN Statute 340A.502)
12. False Third -party liquor liability, or Dram Shop, can apply if there is harm to a third party.
13. False The time alcohol begins to affect the body after consumption depends on whether the pyloric valve (which
is found above the stomach and below the esophagus) is open.
14. False An average ounce of hard liquor (around 80 proof) contains about the same alcohol as a 12 oz. can of beer
or a typical glass of wine.
15. False The rate of absorption of alcohol into the bloodstream is based on the fat -to -muscle ratio of the individual.
Since fat absorbs alcohol more slowly than muscle, people with a larger percentage of fat will get drunk
more quickly.
16. True You may be arrested for drunk driving with a blood alcohol level below the state threshold for blood alcohol
content .08%, since behavior is a determining factor.
17. True NO drinks may be sold after closing time. Customers may consume their drinks after closing time (1AM or
2AM) if local ordinances permit.
18. False A man and woman of the same weight would NOT have the same BAC after consuming 3 drinks. This has
to do with women having a higher ratio of fat -to -muscle than a man with the same overall weight, thus the
woman would have a higher BAC.
19. True The consumption of alcohol by a pregnant woman can have harmful effects on the unborn baby. No alco-
hol should be consumed by a pregnant woman.
20. True You can accept a Tribal I.D. as long as it is not expired and contains the legal name, date of birth, signature,
and picture of the enrolled tribal member.
21. True Minnesota Law Section 340A.702 Subdivision 8.
22. False Drivers licenses from any foreign country other than Canada are not acceptable. The only I.D. that is
acceptable for alcohol purchase from a foreign national is a valid passport.
23. True Minnesota law allows you to confiscate any identification that you reasonably believe is being used to pur-
chase alcohol illegally. It must be given to law enforcement within 24 hours.
24. True Provided the restrictions apply equally to all sales of non -intoxicating malt liquor and intoxicating liquor.
Make sure you know the additional restrictions under local laws.
25. True Minnesota law 340A.417 Subdivision (a).
26. True 340A.404 Subdivision 11 allows that a person purchasing a full bottle of wine, in conjunction with a meal
purchase, may remove the partially -consumed re -corked bottle.
27. True You can refuse service to someone with an alcohol restriction on the back of their ID.
- 15 -
