CITY OF LINO LAKES <br />RESOLUTION NO. 14-12 <br />RESOLUTION APPROVING WITHDRAWAL FROM <br />CENTENNIAL FIRE DISTRICT JOINT POWERS AGREEMENT II <br />WHEREAS, the City of Lino Lakes' cost share of the Centennial Fire District ("District") is <br />proportionately greater than the other member cities due to Lino Lakes' population growth since <br />the District Joint Powers Agreement was formed between the three cities in 1986, where Lino <br />Lakes now contributes nearly 70 percent of the District budget; and <br />WHEREAS, the City of Lino Lakes has expressed a need to change the voting structure of the <br />District Steering Committee ("Committee") to bring more fairness and openness to the decision- <br />making process; and <br />WHEREAS, the Committee voted in favor of recommending an amendment to Section 2.6 of <br />the Joint Powers Agreement on January 15, 2014, which would have amended the voting <br />requirements by including a provision that two Committee members from any one city could <br />"veto" a motion up to four times in any calendar year; and <br />WHEREAS, the cities of Centerville and Circle Pines rejected the Committee's <br />recommendation of the proposed amendment to Section 2.6 of the JPA. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes that <br />a formal withdrawal notice pursuant to Section 11.1 of the Joint Powers Agreement be submitted <br />to the cities of Centerville and Circle Pines. <br />Adopted by the City Council of the City of Lino Lakes this 27th day of January, 2014. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Roeser and was duly seconded by Council Member Rafferty and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Roeser, Rafferty, Stoesz, Kusterman, Reinert <br />The following voted against same: <br />none <br />ATTEST: <br />Juli. e Bartell, <br />y <br />Jeff Reine a or <br />
