CITY OF LINO LAKES <br />RESOLUTION NO. 14-153 <br />AUTHORIZING EXECUTION OF A MEMORANDUM OF UNDERSTANDING <br />REGARDING CITY PARTICIPATION IN THE WELL -SEALING PROGRAM OF <br />THE ANOKA COUNTY WELL HEAD PROTECTION PROGRAM <br />WHEREAS, cities are required by the Minnesota Department of Health and Minnesota Rule <br />§4720.5130 to prepare wellhead protection plans for their community water supplies and cities <br />entered into a Wellhead Protection Joint Powers Agreement in 1997 for purposes of developing <br />the required plans; and <br />WHEREAS, cities are required by the Minnesota Department of Health to implement their <br />wellhead protection plans for their community public water supplies and to coordinate their <br />efforts to protect their well water supply for their communities; and <br />WHEREAS, cities can determine that it is in their best interests to implement the common <br />elements of their wellhead protection plans jointly; and <br />WHEREAS, cities desire to coordinate the implementation of the common elements of their <br />wellhead protection plans through efficient and cost effective cooperation among members; and <br />WHEREAS, the City of Lino Lakes has an obligation to protect drinking water source areas <br />within the city and has completed a Wellhead Protection Plan to comply with that obligation; <br />and <br />WHEREAS, the Minnesota Department of Health has made available the Clean Water Legacy <br />Fund grant program to offset some of the costs of wellhead protection and implementation <br />projects; <br />NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes <br />that the proper city staff shall be authorized to execute a Memorandum of Understanding with <br />Minnesota Department of Health allowing the City of Lino Lakes to participate in the well - <br />sealing program within the scope of JPA language of the Anoka County Well Head Protection <br />Program. <br />Adopted by the Council of the City of Lino Lakes this 8th day of December, 2014. <br />The motion for the adoption of the foregoing resolution was introduced by Council Member <br />Stoesz and was duly seconded by Council Member Rafferty and upon <br />vote being taken thereon, the following voted in favor thereof: <br />Stoesz, Rafferty, Roeser, Kusterman ,-inert <br />The following voted against same: <br />none <br />ATTEST: <br />lianne Bartell, 1 i <br />y <br />Jeff Reinert, <br />
