AGENDA ITEM 6.B. <br />STAFF ORIGINATOR: Paul Bengtson <br />CC MEETING DATE: February 9, 2009 <br />TOPIC: Second Reading: Ordinance Number 01-09 <br />Zoning Ordinance Amendment <br />Amending the Definition of Private Kennel to <br />match the City Code. <br />BACKGROUND <br />In response to concerned residents, the City Council adopted a new definition of <br />the term Private Kennel, which allows three dogs on any property instead of the <br />previous limit of two dogs. This definition is repeated in the Zoning Ordinance for <br />the purposes of enforcing the requirement of a Conditional Use Permit for <br />Commercial Kennels, and it is therefore necessary to consider an amendment to <br />the Zoning Ordinance to match the definitions. <br />On January 26, 2009 the City Council voted 3-0 to approve the First Reading of <br />this Ordinance. <br />ANALYSIS <br />The definition of Private Kennel should reflect the following changes: <br />KENNEL, PRIVATE. Any structure or premises on which bctwcen 3 <br />(three) and 4 (four) dogs, over six months of age, are kept for private <br />enjoyment and not for monetary gain. <br />PLANNING AND ZONING BOARD <br />On January 14, 2009 the Planning and Zoning Board held a public hearing and <br />unanimously recommended approval. <br />RECOMMENDATION <br />Staff is recommending adoption of Ordinance Number 01-09, amending the <br />Zoning Ordinance definition for Private Kennel. <br />
