1St Reading: <br />7/ <br />27 / <br />2009 <br />Publication: <br />8/16/2009 <br />2nd Reading: <br />8/ <br />1 0/ <br />2 0 0 9 <br />Effective: <br />8/ 1 7/ 2 0 0 <br />9 <br />Council Member <br />Stoltz <br />moved for adoption of the following ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 04-09 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE TO AMEND THE <br />LIMITED BUSINESS AND GENERAL BUSINESS DISTRICTS TO ALLOW PUBLIC, <br />EDUCATIONAL, AND RELIGIOUS USES AS CONDITIONAL USES <br />AND <br />AMENDING SECTION 700 OF THE CITY CODE SO THAT THE REQUIRED <br />DISTANCE FOR LIQUOR LICENSES SHALL NOT APPLY IF A SCHOOL OR <br />CHURCH IS IN A LIMITED BUSINESS OR GENERAL BUSINESS ZONING <br />DISTRICT <br />Section 1 Findings <br />1. The Lino Lakes Zoning Ordinance allows public, educational, and religious buildings as <br />conditional uses in the Rural and Residential zoning districts. <br />2. The Lino Lakes Zoning Ordinance allows private lodges and clubs as conditional uses in the <br />Limited Business and General Business zoning districts. <br />3. The Religious Land Use and Institutionalized Persons Act of 2000, known by the acronym <br />RLUIPA, requires a city to treat religious uses such as churches the same as the city treats <br />other similar uses. Lodges and clubs are similar to public, educational, and religious uses in <br />their activities and potential impacts. <br />4. Section 2, Subdivision 1 o the Zoning Ordinance requires consideration of possible adverse <br />effects of a proposed zoning amendment and that the judgment of a proposed amendment to <br />the Zoning Ordinance shall be based upon, but not limited to, the following factors: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City Comprehensive <br />Plan. <br />2. The proposed use is or will be compatible with present and future land uses of the area. <br />The Policy Plan chapter of the 2002 Comprehensive Plan lists the following policies <br />that are relevant to the inclusion of institutional uses in business zones. Such policies <br />support consistent requirements for similar uses in business zones. <br />
