AGENDA ITEM 3Ai <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />DATE: December 13, 2010 <br />TOPIC: Second Reading and Adoption of Ordinance No. 11-10 <br />Establishing the 2011 Fee Schedule <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />In order to provide for a more efficient and timely method of reviewing and adjusting the <br />various fees charged by the City, fees are consolidated into one schedule to be <br />reviewed and adopted on an annual basis. <br />The City's current fee schedule has been circulated to department directors with a <br />request to update or amend the schedule as appropriate for 2011. <br />Ordinance No. 11-10 (the proposed 2011 Fee Schedule) is attached. Recommended <br />amendments to the ordinance are printed in red. There are two corrections to the <br />ordinance regarding building fees. In addition to those corrections, changes are <br />outlined below for your review: <br />Achieving Compliance through Education (ACE) Program - In 2010 the <br />council authorized the Lino Lakes Police Department to implement the ACE <br />program (allowing individuals who have been ticketed for certain minor <br />offenses to chose education through the police department as an alternative <br />to going through the court system). Certain fees are attached to the ACE <br />program and it is appropriate to include them in the city schedule; <br />Dangerous Dog Registration — Minnesota Statutes requires proper <br />registration of any dog classified as dangerous and allows for an annual fee <br />to be charged to the dog owner. The city fee schedule did not include this <br />fee so it is being added. <br />Appeal Fee — Zoning Ordinance Section 2, Subd. 4 Administration: <br />Variances and Appeals allows for an Administrative Appeal. The procedures <br />section states that an application shall be accompanied by a fee as <br />established by City Council ordinance. The city fee schedule did not include <br />this fee so it is being added <br />City Staff Services — Department directors are recommending that the fee <br />schedule include language that clarifies how the city charges for certain staff <br />assistance (i.e. data practice requests, research, development project <br />assistance). The finance director has recommended language that allows the <br />city to charge for the specific employee's time based on their hourly rate plus <br />benefits and overhead. <br />
