AGENDA ITEM 3Ai STAFF ORIGINATOR: Julie Bartell, City Clerk DATE: December 13, 2010 TOPIC: Second Reading and Adoption of Ordinance No. 11-10 Establishing the 2011 Fee Schedule VOTE REQUIRED: Simple Majority (3/5 Vote) BACKGROUND: In order to provide for a more efficient and timely method of reviewing and adjusting the various fees charged by the City, fees are consolidated into one schedule to be reviewed and adopted on an annual basis. The City's current fee schedule has been circulated to department directors with a request to update or amend the schedule as appropriate for 2011. Ordinance No. 11-10 (the proposed 2011 Fee Schedule) is attached. Recommended amendments to the ordinance are printed in red. There are two corrections to the ordinance regarding building fees. In addition to those corrections, changes are outlined below for your review: Achieving Compliance through Education (ACE) Program - In 2010 the council authorized the Lino Lakes Police Department to implement the ACE program (allowing individuals who have been ticketed for certain minor offenses to chose education through the police department as an alternative to going through the court system). Certain fees are attached to the ACE program and it is appropriate to include them in the city schedule; Dangerous Dog Registration — Minnesota Statutes requires proper registration of any dog classified as dangerous and allows for an annual fee to be charged to the dog owner. The city fee schedule did not include this fee so it is being added. Appeal Fee — Zoning Ordinance Section 2, Subd. 4 Administration: Variances and Appeals allows for an Administrative Appeal. The procedures section states that an application shall be accompanied by a fee as established by City Council ordinance. The city fee schedule did not include this fee so it is being added City Staff Services — Department directors are recommending that the fee schedule include language that clarifies how the city charges for certain staff assistance (i.e. data practice requests, research, development project assistance). The finance director has recommended language that allows the city to charge for the specific employee's time based on their hourly rate plus benefits and overhead.
