1st Reading: January 14, 2008 <br />Publication: February 5, 2008 <br />2nd Reading: January 28, 2008 <br />Effective: March 6, 2008 <br />Council Member O'Donnell moved for adoption of the following ordinance: <br />CITY OF LINO LAKES <br />ORDINANCE NO. 01-08 <br />AMENDING THE ZONING ORDINANCE TO ESTABLISH A TIME LIMIT FOR <br />COMPLETION OF EXTERIOR IMPROVEMENTS TO STRUCTURES <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota ordains: <br />Section 1 Findings <br />The City Council makes the following findings: <br />1) When building permits are issued but work on the exteriors of buildings is not completed for <br />extended periods of time, the unfinished work can be an eyesore for neighboring property <br />owners and lead to deterioration of building materials. <br />2) Section 2, Subd. 1 of the Zoning Ordinance governs amendments to the Zoning Ordinance. <br />Section 2, Subd. 1.E. states that the Planning and Zoning Board shall consider possible <br />adverse effects of the proposed amendment. Its judgment shall be based upon, but not <br />limited to, the following factors: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City Comprehensive <br />Plan. <br />The amendment to Section 3, Subd. 4.B. of the Zoning Ordinance to require <br />completion of exterior improvements within defined time periods will support the <br />Comprehensive Plan, which includes the following in the Land Use Plan section: <br />General Goals: <br />1. Maintain and enhance Lino Lakes' positive identity. <br />3. Preserve, protect and enhance property values. <br />Residential Goals: <br />1. Maintain and enhance the strong character of Lino Lakes' single family <br />residential neighborhoods. <br />Residential Policies: <br />10. Adhere to the highest community design and construction standards for new <br />multiple family housing construction projects. <br />
