AGENDA ITEM 4A
STAFF ORIGINATOR: David J. Pecchia, Public Safety Director
MEETING DATE: January 12, 2009
TOPIC: 2"d Reading of Ordinance No. 17-08, Amending
Chapter 503 of the Lino Lakes City Code by changing the
definition of a private kennel
VOTE REQUIRED: 3/5
BACKGROUND
On November 3, 2008, the city council received a request from a Lino Lakes resident to
amend the Lino Lakes Animal Ordinance. The current ordinance states that any
resident who owns 3 dogs on one acre of land must obtain a private kennel license. Any
resident with a lot less than one acre can only own two dogs. The request was to add to
the city's animal ordinance a provision to allow foster dogs in addition to the 2 dog limit
on a less than 1 acre parcel of land.
The council has considered options to address this situation, including: no change to
the regulations, a special allowance for fostering, changing the number of dogs allowed,
or changing the acreage requirement. The council also reviewed kennel licensing
requirements for surrounding cities.
At the December 1, 2008 work session, the council directed staff to prepare an
amendment to the city code that would increase the number of dogs allowed (without a
private kennel license) from two to three. The first reading of Ordinance No. 17-08 that
would put an increase into place in the city code was approved on December 8, 2008.
Staff is now presenting the ordinance for second reading and approval. If approved,
the new regulations would become effective 30 days after publication as dictated by the
city charter.
RECOMMENDATION
Second reading and passage of Ordinance No. 17-08, amending Chapter 503 related to
Animal Control, by changing the definition of a private kennel.
