(2) The Enforcement Officer, or the Officer's designated representative, shall be <br />authorized to enter any dwelling, dwelling unit, multiple dwelling, rooming house, or <br />premises at any reasonable time to perform the duties prescribed under this Chapter. <br />The owner, operator, or occupant shall give the Enforcement Officer free access to the <br />entire area for the purpose of completing an inspection, examination, or survey. The <br />license shall be revoked if the Enforcement Officer is not permitted access. <br />(3) A search warrant may be obtained when the occupant refuses to consent to <br />the inspection where: <br />(a) There is probable cause to believe a violation exists within the <br />particular structure; or <br />(b) A determination has been made to conduct periodic inspections of <br />certain areas of the City. <br />(4) No warrant is needed for entry where an emergency condition exists which <br />endangers persons or property and insufficient time is available to obtain a warrant and <br />protect endangered persons or property. <br />(5) Entry under this Section is subject to Minnesota Statutes, Section 5046.211. <br />1009.07. Annual Inspections of Multiple Dwellings. <br />The Enforcement Officer shall inspect the premises of all multiple dwelling <br />buildings at least once a year to insure compliance with this Chapter. <br />1009.08. Access by Owner of Multiple Dwellings. <br />Every occupant of a dwelling unit or rooming unit shall give the owner or operator <br />access to any part of the dwelling unit, rooming unit, or its premises at reasonable times <br />for inspections, maintenance, and making such repairs or alterations as may be <br />necessary to comply with the provisions of this Chapter. <br />1009.09. Notice of Violation. <br />(1) Written Notice. When any violation of this Chapter shall come to the attention <br />of the Enforcement Officer, written notice shall be provided to the licensee or if no <br />license has been issued, notice shall be provided to the owner, operator, or occupant of <br />the premises. Notice shall be by United States mail at the last known address of such <br />person and notice shall also be posted in at least one conspicuous place upon the <br />premises where the violation exists. <br />(2) Time to Correct. The notice shall give the alleged violator a specified number <br />of days, not exceeding thirty days, to correct the violation. The Enforcement Officer shall <br />have the authority to extend the time to correct the violation upon good cause being <br />shown. <br />5 <br />
