1" Reading: - 2 c i Publication: -j --zoo <br /> 2" Reading:.-2, - ' I _ �()y Effective: 3c -Z6t-) q <br /> �Y�l�Kc: Ci. \t Ct�+�1 Pr L- 1 3 2-CO 44 <br /> Council Member RPi nPrt moved for adoption of the following ordinance: <br /> CITY OF LINO LAKES <br /> ORDINANCE NO. 17-07 <br /> AN ORDINANCE VACATING A PORTION OF THE DRAINAGE AND UTILITY <br /> EASEMENT ON LOT 16 BLOCK 4 OF THE RECORDED PLAT PARK GROVE. <br /> The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br /> Section 1 Findines <br /> The City Council makes the following findings regarding the application to vacate a permanent <br /> roadway easement: <br /> 1. Stephen & Jacklyn Tlachac have requested that the City Council vacate a portion of the <br /> drainage and utility easement on Lot 16 Block 4 of the recorded plat Park Grove. <br /> 2. A public hearing was held on January 14, 2008 before the City Council in the city hall on <br /> such request after due published and posted notice had been given, as well as personal notice <br /> `- to affected property owners by the clerk on October 25, 2007 and all persons interested were <br /> given an opportunity to be heard; <br /> 3. It appears that it will be in the best interest of the city to approve such request <br /> Section 2 <br /> Such request is hereby granted and that drainage and utility easement described as follows are <br /> hereby vacated: <br /> The north 15 feet of the south 30 feet of Lot 16, Block 4, PARK GROVE, Anoka County, <br /> Minnesota, except the east and west 5 feet of said Lot 16. <br /> Section 3 <br /> That any person, corporation or city owning or controlling easements contained upon the <br /> property vacated reserves the right to continue maintaining the same or to enter upon such way <br /> �-- or portion thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. <br />
