Marketplace Amendment, page 2 <br />CITY OF LINO LAKES <br />ORDINANCE NO. 03-05 <br />AN ORDINANCE AMENDING THE PLANNED DEVELOPMENT OVERLAY FOR THE <br />MARKETPLACE AS CREATED BY ORIDINANCE 16-01. <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />SECTION I. FINDINGS <br />The City Council makes the following findings regarding the application for amending the Planned <br />Development Overlay for the property described below, based on the factors listed in Section 2, Subd.lE <br />of the Lino Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific policies and provisions of and <br />has been found to be consistent with the official City Comprehensive Plan, as the site is guided for <br />commercial uses. <br />2. The proposed use is or will be compatible with present and future land uses of the area. The site <br />is guided for commercial uses. Land in the area of the site is already developed with commercial uses or <br />designated for such use. <br />3. The proposed use conforms with all performance standards contained herein. <br />4. The proposed use can be accommodated with existing public services and will not overburden <br />the City's service capacity. Utilities are currently available to the site. <br />5. Traffic generation by the proposed use is within capabilities of streets serving the property in <br />conjunction with the public improvements proposed. <br />The Planned Development Overlay for the Marketplace as described in Exhibit A and as approved by <br />Ordinance 16-01 is hereby amended as follows: <br />SECTION 2. DISTRICT PROVISIONS <br />A. Development of the subject property shall be in substantial conformance with the preliminary <br />development plans shown on the following exhibits: <br />Exhibit B <br />Exhibit C <br />Exhibit D <br />Exhibit E <br />Preliminary Plat prepared by Westwood Development Services dated August 8, 2001. <br />Site Plan prepared by Parsons Transportation Group, Inc., dated August 20, 2001. <br />Grading, Drainage and Erosion Control Plan prepared by Parsons Transportation Group, <br />Inc., dated August 20, 2001. <br />Landscaping Plan, prepared by Parsons Transportation Group, Inc., dated <br />August 20, 2001. <br />- 32 - <br />
