CITY OF LINO LAKES <br />ORDINANCE NO. 07-04 <br />AN ORDINANCE VACATING TWO PONDING AND FLOWAGE EASEMENTS <br />ON THE SITE OF OAKWOOD VIEW AND THE RICE CREEK COVENANT <br />CHURCH, 125 ASH STREET <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings regarding the application to vacate two <br />ponding and flowage easements: <br />1. The Rice Creek Covenant Church submitted an application to vacate two ponding and <br />flowage easements on the site to be platted as Oakwood View. <br />2. The easements are described in Attachment A. <br />3. Development plans for the Oakwood View plat provide for adequate stormwater <br />management for the site and the existing ponding and flowage easements are <br />therefore unnecessary. <br />4. The City Council held a public hearing on the proposed vacation on _date , 2004. <br />Section 3 <br />The ponding and flowage easements described herein are hereby vacated. <br />Section 4 <br />That any person, corporation or city owning or controlling easements contained upon the <br />property vacated reserves the right to continue maintaining the same or to enter upon <br />such way or portion thereof vacated to maintain, repair, replace, remove or otherwise <br />attend thereto. <br />Section 5 <br />This ordinance shall be in force and effect from and after its passage and publication <br />according to the Lino Lakes City Charter. <br />-74- <br />
