Speiser Acres <br />Page 2 <br />CITY OF LINO LAKES <br />ORDINANCE NUMBER 08-04 <br />AN ORDINANCE VACATING A DRAINAGE AND UTILITY EASEMENT <br />ON OUTLOT A, HIGHLAND MEADOWS EAST, TO PROVIDE FOR THE <br />DEVELOPMENT OF HIGHLAND MEADOWS EAST 2ND ADDITION <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1 Findings <br />The City Council makes the following findings: <br />1. The development of Highland Meadows East 2nd Addition, as approved by Resolution 04-57, <br />requires the vacation of a drainage and utility easement dedicated with the Highland <br />Meadows East plat. <br />2. The easement is described as follows: <br />All that part of an easement for drainage and utility purposes over, under and across Outlot <br />A, as donated and dedicated on the recorded plat of Highland Meadows East, Anoka County, <br />Minnesota. <br />3. Development plans for the Highland Meadows East 2nd Addition plat provide for adequate <br />stormwater management for the site and the existing drainage and utility easement is <br />therefore unnecessary. <br />4. The City Council held a public hearing on the proposed vacation on July 26, 2004. <br />Section 2 <br />The drainage and utility easement described herein is hereby vacated. <br />Section 3 <br />Any person, corporation or city owning or controlling easements contained upon the property <br />vacated reserves the right to continue maintaining the same or to enter upon such way or portion <br />thereof vacated to maintain, repair, replace, remove or otherwise attend thereto. <br />
