CITY OF LINO LAKES <br />ORDINANCE 26-04 <br />APPROVING REZONING FROM R-1 TO RESIDENTIAL PUD <br />FOR FOX DEN ACRES <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1: Findings <br />The City Council makes the following findings regarding the application for rezoning the <br />property described below, based on the factors listed in Section 2, Subd.lE of the Lino <br />Lakes zoning ordinance: <br />1. Royal Oaks Realty submitted an application for an amendment to the zoning <br />ordinance to rezone land to Planned Unit Development (PUD). The currently zoning <br />of the site is R-1, Single Family Residential. <br />The proposal includes platting the site as Fox Den Acres. <br />3. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Plan, as the site is guided for Low Density Sewered Residential uses <br />and is within the existing Metropolitan Urban Service Area. <br />4. The proposed use is compatible with present and future land uses of the area. The site <br />is guided for Low Density Sewered Residential use. Land to the west is guided for <br />similar use and is developed as a single family neighborhood. Land to the north is a <br />regional park reserve. Existing and anticipated future land uses in the area are <br />considered compatible with the proposed uses. <br />5. Upon compliance with the conditions of approval set forth in Resolution 04-196, the <br />proposed uses will conform with all performance standards contained in the zoning <br />ordinance and other requirements. <br />6. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Utilities are currently available to the site and <br />there is ample capacity for the addition of eight homes. <br />7. Traffic generation by the proposed use is within capabilities of streets serving the <br />property. <br />-27- <br />
