Vacation of easements, granting a variance for
lots purchased by Roger Nelson
BACKGROUND:
The city has attempted to sell tax forfeit lots found in
Lakes Addition No. 2 and No. 3, located on Black Duck Drive.
Roger Nelson, the person who submitted the high bid, has
asked for some setback variances and easement vacations that
would allow him to locate houses closer to the street. The
planning- and zoning board recommended denial on a 3-2 vote.
OPTIONS:
1.. Approve variances and -vacate easements to coincide with
the reduced variances - as follows:
A. Five foot front yard total setback for Lot 1 Block -
k9', and Lot' 6-8, Block 10.
B. Ten foot front yard total setback for Lots 2-7,
Block ?.
C. Approve the variances and vacate the easements (Marilyn .
Anderson has the exact legal descriptions) as requested
by Nelson.
2. Make sure Nelson is aware this approval does not include
removal of borrow material for any outlots .
