CITY OF LINO LAKES <br /> ORDINANCE NO.05-02 <br /> ORDINANCE VACATING CREE LANE, <br /> SHENANDOAH 3Rn ADDITION <br /> WHEREAS,the City Council of Lino Lakes has determined to vacate Cree Lane, <br /> in its entirety,from its intersection with Hokah Drive to its western terminus;and <br /> WHEREAS,a public hearing was held on June 10,2002 before the City Council <br /> in the City Hall Council Chambers after due published and posted notice had been given <br /> on May 21, 2002, and a reasonable attempt was made to give personal notice to all <br /> affected property owners, and all persons interested were given an opportunity to be <br /> heard;and <br /> WHEREAS,it appears to be in the best interest of the City to vacate such street; <br /> and <br /> WHEREAS, four-fifths of all members of the City Council concur in this <br /> ordinance. <br /> NOW,THEREFORE THE CITY COUNCIL OF LINO LAKES ORDAINS: <br /> Section 1. That Cree Lane, as dedicated on the Plat of Shenandoah 3A Addition, <br /> Anoka County, Minnesota, is hereby vacated, reserving therefrom for public use, a <br /> drainage and utility easement over, under and across the easterly ten (10) feet of said <br /> lane. <br /> Section 2. That any person, corporation or city owning or controlling easements <br /> contained upon the property vacated reserves the right to continue maintaining the same <br /> or to enter upon such way or portion thereof vacated to maintain,repair,replace,remove <br /> or otherwise attend thereto. <br /> Section 3.
