CITY OF LINO LAKES <br />ORDINANCE NO. 08-02 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF LINO <br />LAKES BY REZONING CERTAIN REAL ESTATE FROM R-1, SINGLE FAMILY <br />RESIDENTIAL TO GB, GENERAL BUSINESS DISTRICT/ PDO, PLANNED <br />DEVELOPMENT OVERLAY <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />SECTION 1. FINDINGS <br />The City Council makes the following findings regarding the application for rezoning the <br />property described below, based on the factors listed in Section 2, Subd.1E of the Lino <br />Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Plan, as the site is guided for commercial uses. The site is guided <br />for commercial land uses and subject to the conditions of site and building <br />plan/conditional use permit approval the development is consistent with the Lino <br />Lakes Comprehensive Plan. <br />2. The proposed use is or will be compatible with present and future land uses of the <br />area. The site is guided for commercial uses. Land in the area of the site is <br />already developed with commercial uses or designated for such use. Subject to the <br />conditions of site and building plan/conditional use permit approval the site is <br />compatible with existing commercial and residential uses as well as future <br />commercial and residential. <br />3. The proposed use conforms with all performance standards contained within the <br />city's zoning ordinance. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Existing sanitary sewer and water services <br />are available to the site and will not overburden existing public services. <br />5. Traffic generation by the proposed use is within capabilities of streets serving the <br />property in conjunction with the public improvements proposed. Traffic <br />generation by the proposed use is within the capabilities of the streets directly <br />serving the property in conjunction with the required public improvements. The <br />required public improvements are those designated in the Anoka County letter <br />and attached concept plan dated November 20, 2002. The proposed development <br />will assist with the improvement of the Birch/Hodgson intersection signalization. <br />The Zoning Ordinance of the City of Lino Lakes, Anoka County, Minnesota, passed by the City <br />Council on July 14, 1997 is hereby amended by rezoning from R-1, Single Family Residential to <br />
