CITY OF LINO LAKES <br />ORDINANCE NO. 19-03 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF <br />LINO LAKES BY REZONING CERTAIN REAL ESTATE <br />FROM R-3, MEDIUM DENSITY RESIDENTIAL <br />TO LB, LIMITED BUSINESS <br />FOR THE MILLER'S CROSSROADS DEVELOPMENT <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does ordain: <br />Section 1: Findings <br />The City Council makes the following fmdings regarding the application for rezoning the <br />property described below, based on the factors listed in Section 2, Subd.lE of the Lino <br />Lakes zoning ordinance: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City <br />Comprehensive Plan. The project complies with in the comprehensive plan, as <br />reflected by the land use map: the site is guided for Commercial uses. In fact, the <br />current zoning is inconsistent with the comprehensive plan and the proposed rezoning <br />would correct the inconsistency. <br />2. The proposed use is or will be compatible with present and future land uses of the <br />area. The land use map of the comprehensive plan reflects the community's decisions <br />on what type of development should occur in specific locations. The site is guided <br />for commercial uses. Existing and anticipated future land uses in the area are <br />considered compatible with the proposed uses. <br />3. Upon compliance with the conditions of approval set forth in Resolutions 03-142 and <br />03-143, the proposed use will conform with performance standards contained in the <br />zoning ordinance, subdivision ordinance, and other requirements. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. Both water and sanitary sewer service are <br />available in Birch St. The systems have adequate capacity. The City and Rice Creek <br />Watershed District will ensure that stormwater management will comply with the <br />requirements of the City and the Watershed. <br />5. As part of the project approval, Bruggeman and the developer on the north side of <br />Birch have agreed to cooperate in the financing of improvements to the intersection, <br />including turn lanes and traffic signals. The existing problem of a low level of <br />service at the Birch/Hodgson intersection will be improved with this development. <br />
