12-01 <br />Council Member o' Donnell introduced the following ordinance and moved its adoption. <br />CITY OF LINO LAKES <br />ORDINANCE NO. 12.01 <br />AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN BY <br />ALLOCATING 11 ACRES OF MUSA RESERVE TO THE WEST SHADOW <br />PONDS DEVELOPMENT <br />The City Council of the City of Lino Lakes, Anoka County, Minnesota does hereby <br />ordain: <br />Section 1. The City Council finds that the proposed project meets the City's Interim <br />MUSA Reserve Criteria as follows: <br />1. The request for MUSA is occurring concurrently with preliminary plat application. <br />2. The rezoning request is occurring concurrently with the MUSA request. <br />3. MUSA is adjacent to the north border of the site. <br />4. The net acreage for the project is 11 acres, and that is the MUSA request. <br />5. Utilities exist directly adjacent to the site. <br />6. West Shadow Lake Drive is planned as a minor collector road. The extension of <br />West Shadow Lake Drive through the site is consistent with the City's transportation <br />plan. <br />7. The City has reviewed the proposal and determined it will not adversely affect the <br />community health, welfare, or general safety. <br />8. The City has reviewed the proposal and determined that impacts to the environment <br />are mitigated by the wetland plan approved by the Rice Creek Watershed District. <br />Large wetland areas will be retained, and new replacement wetlands will be created <br />for a net increase in wetlands. <br />9. The existing City park adjacent to the development was dedicated in part in <br />anticipation of the park dedication requirements of this development. The park <br />location is consistent with the City's Comprehensive Park Plan. <br />10. The site is within Sewer District No.1 which is consistent with the MUSA reserve <br />agreement with the Metropolitan Council. <br />
